Temporary Speaker, pursuant to Standing Order No.44(2)(c), I rise to request for a statement from the Chairman of the Departmental Committee on Energy regarding the status of retrofitting the Elwak diesel- powered off-grid power station with a hybrid solar photovoltaic system. Elwak is the largest town in Mandera County with a steadily growing population and a rising demand for electricity to support domestic business and public utility needs. In order to enhance electricity access in areas far from the national grid, Kenya Power and Lighting Company (KPLC) commissioned a diesel-powered off-grid stations in remote regions, including the Elwak off-grid station in 2008. However, this diesel-only model has become unreliable, unsustainable and costly due to frequent generator breakdowns, high fuel costs and the rising electricity demand. To address the issue, a hybridisation project was initiated in 2016 to retrofit the Elwak station with a solar photovoltaic system in combination with the existing diesel setup. Although the project is at nearly 80 per cent completion, it stalled since July 2024 due to failure by KPLC to meet the donor condition of onboarding a consultant to assess the work done in order to facilitate payment for the contract. Currently, Elwak is facing the worst power outage since the inception of its electricity supply and there is need to resolve the issue, restore the grid to its full capacity, and fast-track completion of the hybridisation project. It is against this background that I request for a Statement from the Chairman of the Departmental Committee on Energy on the following: 1. Steps that the Ministry of Energy is taking to restore Elwak off-grid power station to its required operational capacity of 600 kilowatts to address power outages. The status of the hybridisation project of Elwak Off-Grid Power Station, including specific timelines for completion of the remaining part of the project, deviation in timelines from the originally projected completion date, and the cost implications, if any. Temporary Speaker, pursuant to provisions of Standing Order No.44(2)(c), I rise to request for a Statement from the Chairman of the Departmental Committee on Environment, Forestry and Mining regarding the indiscriminate and illegal mining activities in Kowidi Location, Kasipul Constituency. The number of miners is steading increasing in Kowidi location. The miners engage in unregulated mining activities that endanger the residents. They leave behind deeply excavated trenches and boreholes, some of which extend to depths of over 150 feet. These hazardous excavations pose significant safety risks to livestock and residents, particularly to children, and have resulted in a number of fatalities. Furthermore, the use of highly toxic substance such as mercury in mineral extraction process not only contaminates water sources, posing a severe health risk to residents, but it is also detrimental to the environment. This is in violation of the provision of the Environmental Management and Coordination Act (EMCA), Cap 387, and the Minamata Convention on Mercury, to which Kenya is a signatory. These dire environmental and safety situations call for stricter enforcement of compliance with environmental regulations in order to guarantee public safety and conserve the environment. It is against this background that I seek a Statement from the Chairman of the Departmental Committee on Environment, Forestry and Mining on the following: 1. Measures that the Government has put in place to ensure compliance with the provisions of the Mining Act, 2016 and the Environmental Management and Coordination Act (EMCA), 1999 to regulate mining activities and safeguard public safety in Kowidi Location. 2. Immediate and long-term actions that the Government is undertaking to mitigate environmental degradation, including compelling illegal miners to refill deep trenches and boreholes and address the drying up of local wells and boreholes. A comprehensive list of all legally registered and licensed gold mining companies operating in Kasipul Constituency and Homa Bay County, their compliance status and the revenue collected by Kenya Revenue Authority (KRA) from their activities in the last five years, including allocations to the devolved government. 4. Following the unfortunate resultant deaths due to these unsafe mining activities, whether the government can confirm that the affected families will receive compensation and if so, what is the proposed compensation structure given that the deceased were primary breadwinners in their respective families?
