  • 16 May 2019 in Senate: Thank you, Mr. Temporary Speaker, Sir. I agree with my colleagues who have spoken before me that what Sen. Kang‘ata is pursuing is an exercise in futility. A few months ago, the Deputy Speaker of this Senate made a detailed ruling about this particular issue when we had a matter that generated more heat than this particular one. I know that Sen. Kang‘ata occasionally walks in and out of the Senate but sitting down and following the proceedings of the House will do him more justice. He should also take time to read the copies of the HANSARD. The electronic ... view

  • 15 May 2019 in Senate: Mr. Speaker, Sir, this is a sad issue that we canvassing as representatives of the people. It is unfortunate that with each passing day, there seems to be an emerging trend where CSs sit in well-furnished air-conditioned offices and make policy pronouncements that have completely no bearing or understanding of the challenges that members of the public face. This rogue policy direction reminds me of the other one where somebody sat in the Cabinet and made a decision that traders who import goods into this country cannot transport them in one container by pulling resources together. This forced them to ... view
  • 14 May 2019 in Senate: Thank you, Mr. Speaker, Sir, for giving me this chance. This matter is sacrosanct and I would want my view to be reflected on it. Article 2(4) of our Constitution states that:- ‗Any law, including customary law, that is inconsistent with this Constitution is void to the extent of the inconsistency, and any act or omission in contravention of this Constitution is invalid.‘ Regarding the matter that you are discussing, it is clear that Article 110 was violated and a pupil in a law firm can convince a court of law to strike out the Act of Parliament that was ... view
  • 30 Apr 2019 in Senate: On a point of order, Mr. Speaker, Sir. I beg your indulgence given the matter that is before us. We know the length at which we have to go to do the Second Reading and conclude. I request that you guide this House in terms of how much time every Senator can take. I propose five minutes if you can agree to that. view
  • 30 Apr 2019 in Senate: Thank you, Mr. Deputy Speaker, Sir. I will be extremely quick because I know we are pressed for time. One cold morning on 11th September, 2001, Al- Qaeda struck at the heart of America. At that particular time, the Congress which was on recess, was recalled. Speaking later on that afternoon, the Congress passed a unanimous decision that Washington had lost touch with the reality and the challenges that the people of their country were facing. We are presented with one such situation. They went on, by using legislative power, to set up Homeland Security which up to date, is ... view
  • 30 Apr 2019 in Senate: Mr. Deputy Speaker, Sir, as Parliament, we have been challenged this afternoon and are being asked to make a very difficult decision; whether devolution will succeed in this country, or whether it will fail. That is the very question that is before us, as Senators this afternoon. If we vote to accept this reduction, we can as well fold up this House and forget that there was once something called devolution in this country. Revenue cannot be growing and yet we keep telling counties to keep on spending less by the day. view
  • 30 Apr 2019 in Senate: Finally, one of the things that we have noted, because I am a Member of this Committee, one policy that the national Government keeps on abusing when determining the revenue to be divided between counties and the national Government is this word “national interest”. We are told the reason they keep on budgeting trillions to the national Government and a paltry to county governments is because of national interest. We will propose legislation to this House to define what national interest is. After that, money shall be fairly distributed across counties as per the dictates of Article 202 of our ... view
  • 10 Apr 2019 in Senate: Thank you, Madam Temporary Speaker. I rise to give my support to this very important issue that is being canvassed by our colleague, Sen. Mwaruma, on behalf of residents of Taita-Taveta County on something that is extremely important. This is an issue that is becoming recurrent. Many of the petitions that are brought to this House relate to how the Government treats innocent citizens of this country, who are powerless and, in terms of the wellness of their economy and cannot afford some of the flashy lawyers that are known in this town who would be able to push the ... view
