  • 7 Nov 2018 in Senate: I can see the protest from my good friend and neighbour, Sen. Omogeni. Therefore, I will try and be extremely careful, because I do not want to be in trouble with him, should I fall afoul with the law one day. Of course, I may need his services or those of the former State Prosecutor, the Deputy Majority Whip, Sen. Kihika. However, I keep telling you, my good friends, that despite the fact that you are advocates of the High Court, when you are making laws, 95 per cent of the people that vote for you and sent you to ... view
  • 7 Nov 2018 in Senate: radio. They tell you that if you do not have a certificate, you pay some a huge amount of money. However, the truth of the matter is that when you speak to most of our artistes they say that never see that money. Most of our artistes, especially musicians, die poor. We see them each and every time. The recent case is that of the late Joseph Kamaru, a celebrated musician. Although I do not speak the Kikuyu language, I used to enjoy his songs. Music is universal; you do not have to understand what a musician is saying. You ... view
  • 7 Nov 2018 in Senate: Issues of intellectual property are not so simple. They are difficult because it speaks to the very being. By the time someone spends hours to create something, if you rob them of what they created, chances are they may never get the courage and energy to again work and put out anything useful for this country. Therefore, I hope this Board will be fair, dutiful and serve people honestly. view
  • 7 Nov 2018 in Senate: There is also the provision to amend. This includes dealing with the offences and purposes of ensuring clarity for providing for offences by bodies corporate which are not provided in the current law, like internet service providers. In 2001, this was just at the advent of the internet age. There are now many forms of sharing content and material that is otherwise copyrighted unlike was the case. Maybe in 2001 the only way they would have used was by ‗burning music into a CD‘. However, with the advent of internet service providers, all this information can find itself around the ... view
  • 7 Nov 2018 in Senate: Other countries have passed these laws and they ensure that their creators of works of art are well taken care of. Preservation of culture is one of the devolved functions. Therefore, it is important to see how our county assemblies take on and further come up with a Bill that gives meaning at the local level to the provisions of this law. In a County like Kericho, the County I represent, for the things we hold dear, the county assembly could provide for the local musicians and how we honor and celebrate them. view
  • 7 Nov 2018 in Senate: This is an avenue for the creation of jobs as well. If our musicians, actors, poets and writers enjoy value for the work they do, that is a whole industry. We are talking about job creation. There is no better silver bullet of job creation than through these works of art because the country is not in any shortage of talented people who can give us good content. There are countries that continue to earn--- Look at the amount of revenue that Hollywood generates for America, that Bollywood does for India and that Nollywood does for Nigeria. There is nothing ... view
  • 6 Nov 2018 in Senate: Thank you, Mr. Speaker, Sir. I support the Petition by Sen. Mwaruma. I saw the tone of the exchange between him and I think Sen. Farhiya in the official WhatsApp group. From it, you are left to wonder what can happen between communities if left without a solution if Hon. Members could get that passionate about these issues. I, therefore, call upon the Committee that will look into this matter to try and resolve it as a matter of extreme urgency with a view of considering the proposals made by our senior colleague, Sen. (Eng.) Mahamud. They could perhaps recommend ... view
  • 6 Nov 2018 in Senate: Thank you, Mr. Speaker Sir. I support this Bill, but with so many amendments. I must apologize because I cannot run away from responsibility. I am a long serving Member of the Committee on Information and Technology and, therefore, consider it as a failure when the House discusses a Bill without the Committee‟s Report. To be sincere, we had many submissions made before us by various stakeholders from the ICT sector, the banking world and private entities among others that have interest in this matter. The last time I checked, we had over 60 pages of proposed amendments and data ... view
  • 6 Nov 2018 in Senate: times on end by either members of the public or the media. You read very private information about different Members of this House and wonder whether the person who drafted that information knew that it would be injurious to the character and person of that human being that is targeted. Mr. Speaker Sir, we have even read stories in the past that have listed medical data. I consider medical records to be amongst the top private issues of a human being. However, we have woken up in the past to read that so-and-so has a certain disease. When you ask ... view
  • 6 Nov 2018 in Senate: Mr. Deputy Speaker, Sir, it is so sad and unfortunate that, as a country, we have not thought of a way of ensuring that we protect the data of our citizens. Today, if somebody wanted to make an informed decision, even very private information will benefit and advance their business interests. For example, if you wanted to find out the number of Kenyans suffering from cancer, that information should be freely and readily The electronic version of the Senate Hansard Report is for information purposesonly.
