These provisions were declared unconstitutional in the Katiba Institute and another versus the Constitution Attorney General (AG) in the constitutional Petition No.209. Clause 26 proposes to delete the provisions of Section 46(1)(b) that requires the petition to recall a MP must be signed by a petitioner who was registered to vote in the election in respect of which the recall is sought and that the petition must be accompanied by an order of the High Court. • 13 Nov 2024 in Senate: Therefore, to clean up our processes, the Bill is proposing that after every electoral cycle, IEBC procures the services of an independent audit firm to audit the entire process from the start; the preparation of the election, election day to declaration of results and also what it costs the taxpayers. They will finally then submit a report to Parliament so that Parliament can make independent decisions of how to further clean up our electoral processes or review certain costs or decisions that are provided for in law that make it extremely expensive to run our elections. Remember, our elections costs ... view

  • 12 Nov 2024 in Senate: I wanted to support Sen. Osotsi. He should not agree to be intimidated by the Majority Whip. What he is saying is factual. None other than the Senate Majority Leader in this House has stated that this habit of County Executive Committee Members (CECM) for Finance and Economic Planning travelling all the way from as far as Moyale, Tana River, Kericho and Kilifi, to come and meet with officers from the CoB to get their budget approvals is a practice that this House must bring to an end. The man who is responsible for that practice is none other than ... view

  • 12 Nov 2024 in Senate: Thank you. Mr. Deputy Speaker, Sir, you were not here but in my moving notes, I said that this is justice to the county assemblies. In 2016, at the Pride Inn Paradise Beach Resort and Spa, if I am not wrong, we had the inaugural Legislative Summit, which brings together Members of County Assembly (MCAs) and the Senate. Part of the takeaways from that Summit, Sen. Onyonka, was that we were going to do this for our county assemblies. It has taken us a freaking eight years to do this for them. It is completely unfair. I really hope that ... view
  • 12 Nov 2024 in Senate: Mr. Deputy Speaker, Sir, I am aware that at the time of going on recess, quite a good number of colleagues had spoken on this amendment and the various considerations that are being proposed. It is my hope that, that captures the gist. Many of the colleagues who spoke to this Report of the Mediation Committee, were in support of the proposed amendments. Therefore, I appreciate them too for the time that they took to speak on this particular Report. With those many remarks, I beg to reply. I request that in accordance with Standing Order No.66(3), the putting of ... view
  • 30 Oct 2024 in Senate: Thank you, Mr. Speaker, Sir. I will make two quick comments. The first one is on this issue of the reported number of wanton killings across the country that we have witnessed the last few days. I also agree with those who are calling on the IG to up his game and bring the country up to date on what is really happening. Mr. Speaker, Sir, it cannot be business as usual when you wake up each day to news of people who have been picked out of taxis, their homes and eventually found to have been murdered. This country ... view
  • 30 Oct 2024 in Senate: Mr. Speaker, Sir, on behalf of my colleagues in this House, I join you in welcoming these students from Starehe and Kianda Schools to the Senate, who I believe are on a study tour. They have found us in the midst of business today discussing statements and should they hang around a little bit longer, they will see us transact other business, either business at the Committee of the Whole or even dispensing off with a Motion that is in the Order Paper. I wish them well in their studies. I also celebrate these great institutions that have produced Kenyans ... view
