  • 4 Dec 2008 in National Assembly: Thank you, Mr. Temporary Deputy Speaker, Sir, because I have finally caught your eye. I have been informed about time by the Minister, and I will be brief in terms of my presentation. I have been intimately involved in the discussions on reforms and, so I support this Report most sincerely. I only want to caution that in terms of our transitional arrangements, we should be aware of the need to have a very critical look at the institutions. We have just set up a new Political Parties Act implementation team. Where will that team fall when we do away ... view
  • 4 Dec 2008 in National Assembly: Absolutely, Mr. Temporary Deputy Speaker, Sir. On the issue of impunity, impunity could be by Parliament, the media or any institution. I am indicating that in terms of impunity, each of our institutions; whether it is Parliament or the media, needs to be aware of the actions that they take, not just in terms of that particular debate that is going on, but also in terms of the wider debate regarding respect for institutions. When you erode the moral authority of Parliament, as the media is doing now, that is impunity. When Parliament decides not to hear the people of ... view
  • 3 Dec 2008 in National Assembly: Thank you, Mr. Temporary Deputy Speaker, Sir. I beg to move the following Motion:- THAT, this House adopts the Report of the Departmental Committee on Administration of Justice and Legal Affairs on the deliberations on nomination of a Commissioner to the Kenya National Commission on Human Rights, laid on the Table of the House on Wednesday, July 30, 2008. The Act under which that Commission operates, the Kenya National Commission on Human Rights Act, 2002, which came into force in March, 2003, mandates the National Assembly to fill vacancies in that Commission. The Commission is made up of nine commissioners, ... view
  • 3 Dec 2008 in National Assembly: Mr. Temporary Deputy Speaker, Sir, Section 9 of the Act proposes a staggered board for the Commission. In other words, the time during which this Commissioners' terms end is staggered to allow for continuity. When the advertisements were done and applications received, the Committee set up a sub-committee to look into the applications that were received and shortlist a December 3, 2008 PARLIAMENTARY DEBATES 3859 number that they thought was reasonable for interviews. The sub-committee then shortlisted 13 out of the 198 applicants. The people who were shortlisted were as follows:- Dr. P.L.O Lumumba, Ndomo Atieno, Kyalo Munyiva Ann, Gitu ... view
  • 27 Nov 2008 in National Assembly: Mr. Temporary Deputy Chairman, Sir, I beg your indulgence so that we could read through the sections so that hon. Members understand. The clause says: Discrimination in access to and distribution of public resources. "2I(1) Public resources shall be distributed equitably and geographically, to take into account Kenya's diversity. (2) It shall be unlawful for any public officer, while in charge of public resources and without justification---" That is very crucial, Mr. Temporary Deputy Chairman, Sir! "---to distribute resources in an ethnically inequitable manner." In other words, ethnically inequitable and without justification. So, there is already a qualification about justification. ... view
  • 27 Nov 2008 in National Assembly: Could you kindly read the new Clause again? view
  • 27 Nov 2008 in National Assembly: Mr. Temporary Deputy Chairman, Sir, we did not look at this proposal. This is not one of the biggest problems we face in terms of discrimination when certain ethnic, or racial groups, tend to congregate towards certain areas and would wish to prevent any other member of the public from getting tenancy, or lettable space, in those areas. So, essentially the mischief is if you create an estate and you wish to have only members of your ethnic group in that estate, it will be discriminatory and, therefore, unlawful; if somebody else were to seek to be given lettable space ... view
  • 27 Nov 2008 in National Assembly: Mr. Temporary Deputy Chairman, Sir, is the good Minister aware that the Secretary is designated as that officer throughout the following several other amendments? Has she looked at that to see if it is possible? view
  • 27 Nov 2008 in National Assembly: Mr. Temporary Deputy Chairman, Sir, it is important to see exactly how it will apply. So, I propose that we go clause by clause. view
  • 27 Nov 2008 in National Assembly: Mr. Temporary Deputy Chairman, Sir, the Commission Secretary is one person. The Commissioners are many. So, if you look at, for example, New Clause 41, if you were to replace the "Commission Secretary" with the "Commissioner", "The Commissioner shall make all reasonable endeavour to conciliate---" Which Commissioner? So, it would properly state "the Commissioner referred to in Clause 39 above". view
