Hon. Speaker, Sir, when you read this Motion, those of us who do not come from this area, get depressed because if you can learn that it is Government agencies that cause untold suffering and miseries to its own citizens for years, you realize that as a country, our ways of doing things are wrong.

There is nothing more important than human lives. One of the main reasons why we spend a lot of money to construct dams is to control flooding. If the same dams that are constructed then cause flooding, it is not a question of lack of engineers and resources, but a question of negligence and the uncaring altitude that is developed by the Government over the years. It is high time that the Government agencies are told and made to act in the best interest of the people of this country. If you look at the functions, I want to remind ...

Thank you, hon. Speaker, Sir. On the issue that has been raised by hon. Neto, if the Bill or the proposed amendment will touch on agriculture, fisheries and food as a function of the county governments obviously, that becomes a Bill concerning counties.

Probably we need your ruling whether the proposed amendment only touches on policy issues. This is because that is a function of the national Government. So, it is a bit delicate but I am sure you can give a ruling whether this touches only on policy, agriculture, fisheries and food. If it is not then it becomes a Bill concerning counties. You cannot again ask this House to waive what has already been given. Probably, what I think the Chair of the Committee should do is to apply provision of Standing Order No.127(5) which says:-

âIf for any reason, at the commencement of the Second Reading the report of the Committee has not been presented, the Committee concerned shall report progress to the House and the failure to present the report shall be noted by the Liaison Committee for necessary action.â Even though the Liaison Committee is mentioned, the Standing Order talks about the Committee reporting to the House. This Bill went for First Reading this morning. What the Committee will do when we embark on Order No.9 is for the Chairman to rise and report to us that they are not ready with their ...

Hon. Speaker, Sir, this Procedural Motion, in my view, is contrary to our Standing Orders because the Bill is already committed to the Committee. So, we cannot waive that provision.

Hon. Speaker, those who stood did not ask for Division. Our Standing Orders are very clear that you stand and call for Division. They only stood and never asked for anything. They are, therefore, out of order and so we proceed with the next Order.
