Temporary Deputy Chairlady, I beg to move:- THAT, Clause 150 of the Bill be amended by─ (a) deleting the words “water works development boards” appearing in Subclause (1) and substituting therefor the words “water works development agencies”; and, (b) deleting the words “water works development boards” appearing in Subclause (2) and substituting therefor the words “water works development agencies”. This is in line with the change of the name of “Water Works Development Board” to “Water Works Development Agencies.”

Temporary Deputy Chairlady, I beg to move:- THAT, Clause 154 of the Bill be amended by inserting the following new subclause immediately after Subclause (4) ─ “(5) The provisions of the Environmental Management and Coordination Act, 1999 relating to water resources conservation and protection and water pollution control shall be exercised subject to the relevant provision of this Act and only in the event that the Board has failed or neglected to take appropriate action to exercise its powers and functions under this Act.” This is to eliminate contradiction and clashes between National Environment Management Authority (NEMA) and Water ...

In the case of 8B, we are giving the Cabinet Secretary a timeline of one year to do a strategy on water resources, how to report back and what should exist in that Bill. What we are trying to do is already in Clause 63 for water services. This is for water resources which is a national Government function. We want the Cabinet Secretary to have a blue-print on which to manage the water resource sector.

Hon. Temporary Deputy Chairlady, I am really convinced that Hon. Neto is fasting! I have just said right now that there are two separate functions and that is the basis of the Water Act 2002 - the reforms to separate water service provision and the management of water resources. In the new Constitution, water services is devolved whilst water resources is a national Government function. So, when they are doing their strategies, there should be two different strategies. There is one that has the implementation bit that involves counties and the rest and one that is merely a national Government ...
