Hon. Deputy Speaker, my point of order concerns the earlier pronouncement of this House. Even the House pronounces itself either by passing a law or by a ruling of the Speaker that Members do contribute. Therefore, the issue I am raising is to what extent the rulings are binding to the public generally. That is because once we pass a law, it binds all of us unless a proper procedure is used in court to pinpoint particular issues. delivered a Motion to the Clerk on the impeachment of Cabinet Secretary, Anne Waiguru but, to our surprise, the CIC went to court and purported to sue Parliament and the court summoned the Speaker instead of summoning the Attorney-Generally, who acts on behalf of the Government of Kenya. Thank you, Hon. Speaker for giving me an opportunity to contribute on the amendments. I would like to touch on the Agricultural, Fisheries and Food Authority Act. This is a little different from the Fisheries Management and Development Bill that we are going to be considering today. I support the amendment that the word “Chairman” be changed to “Chairperson”. great.The Transition to Devolved Government Act is very important because of devolution. The exercise is almost coming to an end and, therefore, the amendments are necessary. I support the Senate’s position. On the Crops Act, which is under the Departmental Committee on Agriculture, Livestock and Cooperatives, the words “biodiversity” and “biosafety” are there. It is good to know that biosafety also covers biodiversity. Therefore, I support the amendment. The Kenya Agricultural, Livestock and Research Act needed to be covered under the new Constitution. I support and I thank you for giving me the opportunity to contribute on these important amendments.

Thank you, Hon. Deputy Speaker for giving me an opportunity to support this very important proposed law. It used to exist previously but on the coming of the new Constitution, parts of it became unconstitutional, necessitating the enactment of this Bill of 2014. I also want to join others in thanking Hon. High Court privileges and its proceedings, also applies to Parliament because of the issue of separation of powers. What has been happening in the recent court matters relating to privileges enjoyed by Parliament is that the courts have reasoned that an Act of Parliament which has been existing, including the one we are enacting, is inferior to the Constitution. Therefore, unless there is a constitutional provision to that effect, the provisions of the Constitution take precedence. I have had an opportunity to peruse through this proposed law. I have seen that it is a good law. We will be urging Members to support it though there may be need to make amendments during the Committee Stage. I have seen the definition of precincts of Parliament. If you look at--- A lot of times, Parliament conducts its proceedings even outside the jurisdiction of Kenya. Therefore, it is good law. In my opinion, there is only one other thing which may not exactly be right, though other jurisdictions have been quoted. A committee sitting to prosecute a Member who has breached privileges are also Members of this Assembly. Looking at times where we have two divides in the House - the majority and the minority sides - then the drawings must be such that you balance the two sides of the House, if not so, then we will end up being judges sitting in our own cause.
