  • 15 Nov 2018 in National Assembly: Thank you, Hon. Speaker for giving me an opportunity to comment on the Petition by the Member for Lang’ata. I want to support it and state that this idea of demolishing houses has become quite common with the excuse of riparian ownership which is defined by law. A lot of time has also lapsed since these buildings were constructed. There was no effort immediately or when the approvals were made to stop construction. view

As it has been stated this is an area we are familiar with and many Kenyans are likely to suffer, property destroyed and many people will end up being homeless. I think it is high time Parliament stood firm to make sure that the law is upheld and Kenyans will not be frustrated unnecessarily. Somebody should not use this to financially exploit these people. view

  • 14 Nov 2018 in National Assembly: Thank you, Hon. Deputy Speaker. It is clear that this is a Private Member’s Bill and the other Bill which is before Senate is from the Government. Therefore, the Private Member has rights and instructions to serve Kenyans whom he represents. The best option is to step down this Bill for consultation. I am sure by now Hon. Njagagua who is a senior lawyer is also guided by our debate, so that as the Mover of the Private Bill he may be persuaded to also pursue the interest of the people he is representing either at the level of the ... view

You know the process of arbitration has a whole Act of Parliament which manages it and it has processes which are conclusive such that whether you introduce the Cabinet Secretary or not, the moment there is an arbitrator in place, the law takes its course and even if an award is not acceptable or has issues, it can be subjected to directions of the High Court. On page 412, with regard to the matter on the Cooperative Societies Act, my Committee prepared a report for the Cabinet Secretary and Principal Secretary for Industry, Trade and Cooperatives who appeared before our Committee. They disowned these amendments and said that they never originated from neither their Ministry nor the cooperative movement. The cooperative movement was also summoned. Speaker, when this Bill was read for the First Time, my Committee summoned the Cabinet Secretary and Principal Secretary in charge to appear before our Committee. We made a report. They appeared before the Committee together with the cooperative movement leadership. They said that they did not propose this sort of law through the Cabinet or any system from their Ministry.
