Mr. Temporary Deputy Chairman, I beg to move:- THAT, Clause 51 be amended by deleting sub-clause (1) and substituting therefor the following new sub-clause- (1) The provisions of this Act shall be complimentary to any other development efforts by the national government, the county governments or any other agency and nothing in this Act shall be taken or interpreted to mean that an area may be excluded from any other development programmes. This is just to ensure that allocations to CDF should not exclude the provisions from benefitting from national government, county government, NGOs or any other agency.

Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, Clause 53 of the Bill be amended- (a) By deleting sub-clause(1) and substituting therefor the following new sub- clause- (1) All complaints and disputes by persons arising due to the administration of this Act shall be forwarded to the Board in the first instance. Mr. Temporary Deputy Chairman, Sir, the import of this is that we want to make abundantly clear that all complaints and disputes must go to the Board in the first instance and not to courts.

Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, Clause 55 of the Bill be amended- (a) by deleting sub-clause (2); (b) by deleting subclause (8) and substituting therefor the following new sub-clause- (8) Any person who was an officer or employee of the former Board immediately before the commencement date of this Act shall be deemed to be an officer or employee of the Board on the same terms he or she was serving before the enactment of this Act. Mr. Temporary Deputy Chairman, Sir, basically what the Minister is referring to is within his power; it is for him to do whatever he likes. We are not creating this law to disposes the Board. We want this for purposes of continuity, so that nobody feels that because he is alone in town, he is kicked out of office. If somebody is found culpable after investigations, there are normal ways to address that. This is why I am talking of terms of appointment or the expiry of the term. This is the normal way in which business must be conducted.

Mr. Temporary Deputy Chairman, Sir, before you put the Question, I want to give a counter argument to that of the Minister and Eng. Gumbo. You have heard from one side. This is a public fund which is going to all the constituencies all over the country. The participation by these nominating bodies, in terms of getting nominees to the Board, has made it more participatory in terms of public participation, which is a constitutional requirement. Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, the Second Schedule of the Bill be amended – (a) by deleting the word “STANDARD” appearing at the heading of the Schedule; (b) by inserting the words “Constituency Name” immediately after the words “Constituency No”; (c) by deleting the word “Secretary” and substituting therefor the word “Chairman CDFC”; and, (d) by deleting the words “secretary CPC Committee”.
