  • 23 Mar 2021 in Senate: Thank you, Madam Deputy Speaker. I rise Pursuant to Standing Order 51(1)(a) to give an update on the Constitution of Kenya (Amendment) Bill 2020. Following directives of the two Speakers of the National Assembly and the Senate. The departmental Committee of Justice Legal Affairs of the National Assembly and the Senate held meetings to consider the Constitution of Kenya (Amendment) Bill 2020. Following our meetings, both Committees received memoranda pursuant to a public invitation on public participation that took place in the sittings that were held in this House on the 12th March, 2021, 16th and 17th March 2021 to ... view
  • 23 Mar 2021 in Senate: we want to undertake a process that can stand any constitutional test. Let us bear in mind that any process that we undertake, as Parliament, is subject to the supervisorial jurisdiction of the High Court. Arising from a similar process that was undertaken by the County Assembly of Tana River, the High Court has nullified the proceedings that took place before the County Assembly of Tana River. Therefore, I urge Members to give this Committee and Parliament an opportunity to interrogate the Constitution of Kenya Amendment Bill, 2020 and go through a process that can withstand any Constitutional challenge. Therefore, ... view

  • 3 Mar 2021 in Senate: Thank you, Mr. Speaker, Sir. First, I thank Sen. Khaniri for bringing this very important Statement to the House. Anybody who uses power in any part of this country will affirm that power that is being provided by Kenya Power is the most unreliable. If we go down memory lane, we know that privatization has made life easier for many Kenyans. If we never allowed companies like Safaricom and Airtel to set foot in Kenya, we would not be having access to communication through mobile phones the way we are do. Unless we solve the problem of monopoly by Kenya ... view
  • 3 Mar 2021 in Senate: Why are we not opening up this sector by inviting other investors to come and provide reliable and cheap electricity to Kenyans? Why are we behaving like we are in stone- age? That will be a source of jobs. Tennessee Valley provided jobs to many Americans and it controlled floods. The other day I was at home enjoying an evening and then power went off. I never saw it until the following day; no warning no nothing. Even if you called the customer care line, you will call for eternity, nobody will pick your call and there will be no ... view
  • 3 Mar 2021 in Senate: Thank you, Mr. Speaker, Sir. First, I want to disclose to the House that my Committee was already seized of this matter. We had a meeting this morning and quite a number of weighty legal issues came up for deliberation before the Committee. Before you gave this Communication to the House, as a Committee, we had agreed to get some advice from the legal team. We were to meet tomorrow to develop some position as a Committee. Now that we are where we are, we respect the Communication from the Chair and my Committee will proceed to consider this matter. ... view
  • 3 Mar 2021 in Senate: Thirdly, you can look at the process of amending the Constitution under Article 256. If you look at the sub-heading, it says: “Amendment by Parliamentary Initiative.” There is a whole process that has been enumerated in Article 256. If you go to Article 257, it says, “Amendment by Popular Initiative”. So, the two processes are distinct. When you go to the one that is through Parliamentary Initiative, in Article 256 (b) and (c), there must be 90 days when the Bill is first read in the House before it goes to the next stage. However, if you go to Article ... view
  • 2 Mar 2021 in Senate: Mr. Speaker, Sir, I join my colleagues in thanking the Chairperson of the Committee on Labour and Social Welfare, Sen. Sakaja, for the good work he is doing. I would also like to confirm to this House that Sen. Sakaja is a very dedicated and effective Member of the Committee on Justice, Legal Affairs and Human Rights. This programme was meant to serve a very useful purpose to the vulnerable people within the society. However, just like any new programme, it has a number of teething problems. One of them is that a number of people in the rural areas ... view

  • 2 Mar 2021 in Senate: Madam Deputy Speaker, the number of people who are vulnerable, who qualify to benefit from this fund, keeps on rising year in, year out. I want to appeal to the Chair to urge the Cabinet Secretary (CS) for Labour and his staff to do another campaign, so that he can recruit new beneficiaries, especially those who have really suffered due to the COVID-19 effects. The Chair of the Committee on Labour and Social Welfare was our Chair in that Committee and knows the discussions that we went around people who are adversely affected by this COVID-19 pandemic. I hope that ... view
