  • 8 Nov 2022 in Senate: I wanted to make a comment because this is a House of record and procedure. What we do today may come back to haunt us tomorrow. Mr. Speaker, Sir, the tradition of this House has always been that if the SBC meets to consider the business that should be transacted on a particular day, that business can only be stood down by this House, unless a subsequent meeting of the SBC is held and they come up with another agenda. Mr. Speaker, Sir, I have heard you communicate to the House that there was a unilateral discussion between you and ... view
  • 8 Nov 2022 in Senate: If this matter was deliberated by the SBC, it should be included in our Supplementary Order Paper today. If there is any decision that is to be made to drop that particular agenda from the Order Paper today, it should be with the concurrence of the House. Otherwise, if we start running our business as people who are under instructions from the National Assembly, we shall remain a House that plays subservient to the dictates of the National Assembly. view
  • 8 Nov 2022 in Senate: Thank you, Mr. Speaker, Sir. My good friend and classmate, Sen. Mungatana, has raised as important issue on that matter of sub judice . That particular order has conditions. The burden on who must prove that this matter is active in court is on the Senator invoking the rule on sub judice . If a may read to you, Standing Order No.103 (4) reads: “A Senator alleging that a matter is sub judice shall provide evidence to show that paragraphs (2) and (3) are applicable.” The word used is “shall”. view
  • 8 Nov 2022 in Senate: The only way this particular Standing Order can be of assistance to my learned friend, Sen. Mungatana, is by him tabling evidence before the House, showing that there are proceedings before a court of law that are active. You cannot seek to be assisted by Standing Order 103 without tabling evidence before the House. view
  • 8 Nov 2022 in Senate: Mr. Speaker, Sir, having listened to him, he has made general comments on matters pending before courts of law. However, he has not made reference to particular cases, the stage of the matter and how what is being discussed here will affect the outcome of the matter. view

  • 27 Oct 2022 in Senate: Thank you, Mr. Deputy Speaker, Sir. I know Sen. Cheptumo has just arrived fresh from the National Assembly. I want to remind him that the National Assembly is like a double intake, with 349 Members. Here, we are only 67. Sen. Cheptumo, in appreciation of that fact, Standing Order No.53(3)(a) states that- “Where a statement has been requested from a Committee pursuant to paragraph (1) – (a) the Speaker may allow comments in relation to the Statement for not more than 15 minutes.” Mr. Deputy Speaker, Sir, riding on Statements is captured in our Standing Orders. This has been a ... view
  • 27 Oct 2022 in Senate: Thank you, Mr. Deputy Speaker, Sir. I also want to ride on the Statement that has been sought by Sen. Faki I would like the Committee to explain to the House why the SRC in the said Gazette notice has not reviewed upwards the remuneration of various cadre of lowly paid state officers, including Early Childhood Development Education (ECD) teachers, nurses, drivers and other cadre of members of staff. On gazette Notice 5686, I want the Committee to make an inquiry whether there has been a conflict of interest from the Chairperson of the SRC and explain to the House ... view
