Mr. Speaker, Sir, allow me to hail Mr. Mutunga Mutuku, a resident of Makueni County, the Governor for Nairobi, the Governor for Kisii County as well as Mr. John Gitau for petitioning the Senate using that constitutional provision to address issues that may be affecting them or the society. On the petition by Mr. Mutuku, the story reads the same in all the counties where county governments have blatantly and deliberately flaunted procurement procedures, refused to involve the public in what they are doing yet it is expressly provided for in the Constitution that public participation is mandatory. Mr. Deputy Speaker, Sir, you can see the casual way in which the Vice Chairperson is responding to this issue. This is a matter to do with security of Kenyans. Matters to do with security take precedence. This is a case where the rights of Kenyans are being violated. I thought that this Statement should have been given priority. It has been on the Order Paper for the last two weeks since we resumed and every time it comes up, they ask for more time. Mr. Temporary Speaker, Sir, Kakamega County happens to be my neighbouring county. My birth certificate reads that I was born in Kakamega before Vihiga was hived off from Kakamega. Therefore, the youth in the Speaker’s Gallery are from home. Mr. Temporary Speaker, Sir, I have no doubt in my mind whatsoever, that the good Sen. (Prof.) Lonyangapuo can preside over the affairs of this House. However, electing somebody who presides over the affairs of the House is a bipartisan issue. If Sen. Mr. Deputy Speaker, Sir, I rise to support this petition and to hail the two patriotic Kenyans from Nyamira for their vigilance. For devolution to succeed, residents must also take interest and remain very vigilant on what is happening in their counties and, when there are issues like this, it is important that they flag them out like they have. Mr. Deputy Speaker, Sir, clearly the Chairperson is not ready to answer these questions. He is not responding to the specific points of orders being raised by Members about specialized equipment. I want to propose that this Statement be deferred for the Chairperson to table the contract for us to scrutinize it and know the definition of specialized equipment as per that particular contract. This statement should be deferred for us to do justice to it.

Mr. Deputy Speaker, Sir, indeed, this is a very serious matter. The statement that was made by the Deputy President did not only violate Chapter Four of our Constitution on the Bill of Rights but also the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights and the African Charter on Human Rights. Mr. Deputy Speaker, Sir, the first part of the question has not been answered and that is the bottom line.

Mr. Deputy Speaker, Sir, I got it from the Clerk’s Office. So, I thought you have had a chance to look at it. I want to agree with the Vice-Chair of the Committee that this Statement does not adequately address the issues that I have raised and I will leave it to you to rule if she will read and then we can interrogate or of she will come back with a proper Statement.
