No communities will continue to hold their land as communities. Under this law, you own nothing and everything. People will want their title deeds one way or the other. So, in future, the Land Adjudication Act will still apply on community land to get every member of that community to own his or her piece of land. Hon. Temporary Deputy Chairman, there is no statute called the Environmental Management and Coordination Act, 2015. The one that exists is Environmental Management and Coordination Act, 1999. The Bill to amend the Act was an Amendment Bill. It was a Bill amending the Act of 1999, but retaining the original Act. There was no repeal. This is a mistake by the Clerks of the Committee in the Senate and the Clerk himself who forwarded the amendments to us.

THAT, Clause 77 of the Bill be amended by inserting the following new paragraph immediately after paragraph (a)- (aa) The land in section (a) shall not include government settlement schemes already registered before the commencement of this Act.

Hon. Temporary Deputy Chairman, I want to oppose this amendment. There is a riding principle that a two-thirds majority of this Assembly can override both the President and the Senate. If there is a stalemate between the National Assembly and the Senate, there should be mediation. In a case where mediation fails, this House must reserve its right to be required to pass that agreement or reject it with a two-thirds majority. I reject this and retain the original Clause 9 of the Bill.

Thank you very much, Hon. Temporary Deputy Speaker. I wish I could speak as fluent Kiswahili as my brother. Unfortunately, I originate from where we are very far from the language. This language has never been Nilotic. I support the Report of the Committee of the whole House. I, particularly, praise the constitutional principle of the bicameral process of handling Bills of this nature because what the Senate has done has enriched what we, as the National Assembly, did. Thank you, Hon. Deputy Speaker for giving me an opportunity. I rise to support the Report of the Committee. At the outset, water services in this country are a shared function between the national Government and county governments. The Water Bill stipulates mechanisms within the water services sector. Therefore, as per the Constitution of Kenya, the Senate and the National Assembly must both concur on the final text of the law before it proceeds to the President. This system enriches legislation.
