  • 26 Aug 2015 in National Assembly: Hon. Temporary Deputy Chairman, we do not want fishy business with the Fisheries Management and Development Bill. It is a very serious matter. The Chair of the Committee is not explaining to us the effect of the amendments proposed under (b) down to (c). Most importantly, if you look at sub-clause (1) of Clause 5, the Clause is being amended from emphasis on ecologically sustainable development to promoting fish in traditionally non-fishing communities. We may take some of those phrases for granted but this is why we are in a situation where, in the community where I come from, where ... view
  • 26 Aug 2015 in National Assembly: Thank you, Hon. Temporary Deputy Chairman. I would like to thank the Departmental Committee Chair for reducing the number of CSs in the council. In terms of paragraph (e), I imagine that this is coming in because we have exclusive economic zone running up to the 200 nautical miles away. I was thinking that, in line with your advice to Hon. (Eng.) Gumbo, the Departmental Committee Chair should consider mentioning the Cabinet Secretary for Defence and Foreign Affairs. Currently, in the Government structure, they are merged but the most important thing in terms of securing our fish stock in the ... view

  • 26 Aug 2015 in National Assembly: Hon. Temporary Deputy Speaker, I thank Members of the House present for pushing the Bill to where it is but there would be need for us to look at some provisions, particularly those ones stopping court interventions over some decisions of the Cabinet Secretary. I thank you. view
  • 20 Aug 2015 in National Assembly: Thank you, Hon. Temporary Deputy Speaker. I thank all my colleagues who have spoken to the proposed amendment Bill. I have said much that I needed to say. I am requesting the Chair to permit me to donate two minutes each to Hon. Mwadime, Hon. Manje and three minutes to Hon. Dalmas Otieno and then I conclude. view

  • 20 Aug 2015 in National Assembly: If I had doubt about the need for this law, it has been clarified by the contributions made. I want to thank each and every one of us who has contributed by statements before this House and those who contributed even in silence or in the caucuses we had. So far as I have known, this would be the last House of Parliament to seek to curtail court jurisdiction. Let me make it clear again to Kenyans outside there that, that is not what Parliament is seeking to do by this law. All we seek to do is to give ... view
  • 19 Aug 2015 in National Assembly: Thank you, Hon. Deputy Speaker, for the great opportunity to move this amendment to our Constitution. Hon. Deputy Speaker, I beg to move that the Constitution of Kenya (Amendment) Bill, National Assembly Bill No.2 of 2015 be now read a Second Time. The Bill we have before us would not be necessary if the organs of Government clearly kept to their places of work, functions and roles and time without interfering with others. This Bill would also not be necessary if we operated under the previous Judiciary where we had judges who were firmly anchored on some of these constitutional ... view
  • 19 Aug 2015 in National Assembly: In this Bill, I am seeking to cure a situation which worried the nation quite a while back and it is something that continues to bother people. The idea that courts have been intervening on matters Parliament is dealing with while those parliamentary proceedings are still going on. I am not saying that the courts ought not to check Parliament. Legitimately, the courts must check Parliament in the exercise of the authority given by the people of Kenya. However, now that the courts seem not to be alive to the need to keep detached from parliamentary actions and proceedings until ... view
