I was with him from the airport to his home. May I condole the family. If you look at the organization of the police system around that area, you will why we should not be looking at how we can firm up the Police Force rather than insisting on acknowledging something that is not properly constitutional. As a Member of the Justice and Legal Affairs Committee, I needed to tell the Members of this House the difficulties we experienced in considering this matter. Somebody like me was taught the Law of Contracts and enforcement of contracts by Commissioner Ahmednasir Abdullahi.   • 7 Nov 2013 in National Assembly: Court of Appeal, stated that the courts never interfere with the functions of Parliament--- In fact, it is stated that Kenyan courts lack jurisdiction to inquire into internal proceedings and the workings and functions of the Parliament. It has never happened before and it surprises me that the JSC, given an opportunity to converse with the leadership of the nation at the forum of Parliament, through a Parliamentary Committee, chooses not to come and goes elsewhere. We sat, as a Committee, and determined that it was not for us to find as to the guilt or culpability of any of these individuals but let me tell hon. Members that, on an affidavit, a party said that one of these Commissioners coached the Chief Justice.   • 7 Nov 2013 in National Assembly: cheques, adding to millions of shillings, being shared. Is that not a breach of the provisions of the Advocates Act? What does Article 251 mean when it says “serious violation of the Constitution or other law”? The Commissioner, who is a serious lawyer of about 50 years of age and former Company Secretary of the National Bank comes and says that a Commissioner ought to hand over confidential material – in fact, confidential communication between the advocate and the bank.   • 6 Nov 2013 in National Assembly: Thank you, hon. Temporary Deputy Speaker, Sir. Could this House be told how much money has so far been spent on resettling or compensating IDPs? Secondly, this problem affected virtually the entire country. I want to know the ethnic data of the beneficiaries of the money so far paid. Who were there in terms of their ethnic origins? Lastly, this matter is so important. I was questioning whether really we should not be or whether it is possible we get directions on a proper report, so that the matter is interrogated in detail. view

This issue has been approached in a manner that makes us laugh but it is a very serious issue affecting not only the schools mentioned but I believe very many areas of the country. I wanted to request that the Committee reviews and comes up with an overall policy to many places. I will be glad to personally invite them to my constituency because I have many cases where pupils are being infected with HIV/AIDS or being raped and the local administration is doing nothing about this.   • 5 Nov 2013 in National Assembly: THAT, the Motion be amended by deleting paragraphs six and seven on Page 96 and paragraphs 16 and 17 on Page 98 of the recommendations of the report. Hon. Speaker, paragraphs six and seven were previously amended and what it now states is that the recommendations will be implemented, subject to what is happening in the Court of Appeal. I have done a bit of arbitration and may I confirm to my colleagues that truly, the forum where corruption is being perpetrated in the country is in arbitral processes.   • 5 Nov 2013 in National Assembly: So, unless we have clear evidence that the monies which were received actually rigged a judge to rule, I am requesting that we be alive to the fact of the difficulties, even the judges dealing with this award, based on the limitations of the law of the Arbitration Act we are dealing with. Let us not have a situation where judges are erroneously provoked. In fact, in the long run it may undermine what the EACC may achieve for us.
