Mr. Temporary Deputy Speaker, Sir, following your directions on the 29th of November, 2012 and further directions on the 6th of December, 2012, I beg to respond as follows:- Mr. Mwau, the Member for Kilome, provided me with a copy of a letter dated 5th December 2012 which I forwarded to the Director of Public Prosecutions (DPP) for his comments. That is in the affirmative. I am also able to confirm that Interpol, the United States of America Government and the authorities in the State of Maryland were kept informed in the manner that the hon. If the statement made in this House on 17th February, 2011, claimed that the letter in question, the letter of 29th March, 2009, related to any person other than George Kiragu, then that statement was in error. view

I would like only to make two points. Sometimes there appears to be a misconception that the Constitution we have enacted has created a federal state. Nothing could be further from the truth. The reasoning behind this is the same as that of the Office of the Attorney- General. It is to complete the constitutional separation of these two offices. The people of Kenya in their infinite wisdom decided that the functions of the Chief Prosecutor of the Republic should be in the hands of an independent person who enjoys security of tenure.
