If it does not address that aspect, then we, as the Senators who represent counties, will have to be careful to scrutinize it and make sure they address community land. If we do not have that opportunity to do so, this otherwise good law might not be properly implemented because of regulations which do not come to this House.   • 21 Nov 2018 in Senate: Mr. Speaker, Sir, I especially represent a county where almost all the land is community land. We had a problem with the way county councils had been dealing with community land. More often than not, they do not even follow the Trust Land Act which has been in place, for them to administer these community lands. That is why we find that community land ends up in private hands without following the due process where the communities are supposed to be consulted before any change of the land use is done.   • 21 Nov 2018 in Senate: Mr. Speaker, Sir, right now, county governments hold community land in trust. I think we have repealed all the Acts such as the Trust Land Act which were used to administer these lands. The earlier we advise our communities to register their lands, the better. We also have to sort out these disputes between boundaries of community land so that we can easily sort out this issue once and for all, because once they are titled, then we will not have these loopholes of community lands being grabbed. Part 2 of the Fourth Schedule of the Constitution has an aspect of controlling and regulation which we have to balance with other aspects of safety, noting that most of the advertisements are done along road reserves. view
  • 13 Nov 2018 in Senate: I remember when we started setting up county governments, there was a misunderstanding between county governments and the national Government‘s state agencies dealing with roads. The state agencies wanted to have a say in what should be advertised on the road reserves. The county governments just read the Constitution as it is and said that it is their function. They had to take each other to court for interpretation of that. view
  • 13 Nov 2018 in Senate: This law will go a long way in creating a working relationship so that state agencies managing roads ensure that there is always safety on the roads. When roads are constructed, normally we have what we call side distances where when one is moving from one section to another, there is a minimum distance you have to see ahead of you. If the advertisement boards are not regulated, they will obstruct that vision. That is why the state authorities are coming in. view
  • 13 Nov 2018 in Senate: It is good that Sen. Poghisio has clearly indicated that the licensee has to clear with the relevant authority. I would like to note that in Clause 4(2)(b)(ii), they should have stated the state agency in charge of a particular road type. That way, we will make sure that the law is applicable even when we come up with changes in the road sector. In the case of other surveillance equipment, you have to clear with the police to make sure that you do not obstruct any of the surveillance equipment on the roads. view
  • 13 Nov 2018 in Senate: Mr. Temporary Speaker, Sir, there is need to regulate advertisement because we have seen proliferation of signs on the roads. You will always find ―X‖ marks on them showing that they were not properly licensed. To avoid that, we have to give clear guidelines on how to get licences. Sometimes those officers are not aware of the process but if we have a clear law, then we will easily avoid the mushrooming of advertisement and billboards on our roads. view
  • 13 Nov 2018 in Senate: On the issue or revenue, it will be a good source of revenue for the counties. However, as the Bill is, it is not something that counties can initiate. It will depend on the interests of the advertisers and those interested to advertise in a particular area. view
