Mr. Speaker, Sir, Articles 62, 63 and 64 try to define what is public land, community land and private land. This particular Article 63 tries to define what community land is. Quite frankly, definitions given to these three categories of land are completely out of this world. Nobody really would have expected a game reserve in Maasai Mara to be classified as community. Nobody can expect that a small river in Nandi cannot be classified as community land. Therefore, this amendment as proposed is relevant. Mr. Speaker, Sir, I rise to second this amendment. The functions of the Land Commission as enumerated in Article 67 are not different from what the Commissioner of Lands has been doing. The whole purpose of rewriting this Constitution is to be able to redress some of the injustices that have happened in the past. One of those things has been the centralized management and allocation of land. But while I support this amendment, I want to raise my objection to hon. Members who think we should support this amendment and rise above what we did this morning. Why did they not rise up in the first place, this morning? That is a negative argument. The Constitution we are making is for the whole country. As it is, although I am supporting this amendment, it is already in the doldrums. It is already being derailed by our actions this morning. So, I do not know how that can be redressed.
