  • 16 Oct 2013 in Senate: Mr. Speaker, Sir, if I remember well, there was an amendment to the Kenya National Examinations Council Act which the learned Senator talked about. The amendment was to deal with the mischief of retaining these certificates. In fact, it was to address the practice by schools of retaining these certificates. What is being done now in the name of other laws is to frustrate a substantive Act of Parliament dealing with issue of certificates. I think the Chairperson should explain this extensively, because if his argument can be taken to extensor and going to other fields, you may one day ... view
  • 8 Oct 2013 in Senate: Mr. Deputy Speaker, Sir, if you allow me. Just for the purposes of my friend, Sen. Kagwe, is that instead of adapting, we are noting it. So, we have done something; we have noted it, and then it goes back to the Committee, and then it will be brought back to us. • 8 Oct 2013 in Senate: Madam Temporary Speaker, first of all, I congratulate Sen. Haji for bringing this Motion. I just want him to appreciate a point that I want to make. It is a very important point because of the new constitutional dispensation. Under the current Constitution, if your citizenship is by birth, you cannot lose it even if you acquire another citizenship. So, what I want to say is this so that we do not send the wrong signals; that purely because somebody has gone to the refugee camp and said that he is not a Kenyan; that in itself is not a ... view
  • 8 Oct 2013 in Senate: Madam Temporary Speaker, luckily, this is already in the amendment. At the end of the day, issues of security and identity are very critical. If you go to America, you will find the continent delving into these problems to an extent that elections are won, fought or lost on the issues of identity and borders. Now that we have had these experiences, we must engage each other to ensure that Kenya is a better place to live in. The answer is not to throw away refugees or to make our people live in camps. The answer is to find a ... view
  • 8 Oct 2013 in Senate: Madam Temporary Speaker, I beg to move and request the Senator for Trans Nzoia to second my amendment. view
  • 8 Oct 2013 in Senate: Thank you, Madam Temporary Speaker. In reply, I just want to associate myself with what Sen. Hassan has said that we were not going to succeed when The electronic version of the Senate Hansard Report is for information purposes only. • 8 Oct 2013 in Senate: No; but I qualified and said that if you look at the entire Constitution, what it embraces are those three words: “All the sovereign power belongs to the people of Kenya;” and if you go to the next chapter, Sen. Kajwang is written all over this Constitution. Look to the chapter on citizenship; again, you will see the footprints of Sen. Kajwang. But one other thing that I must say is that if you look at what is happening in these democracies, like the group of Africans who came from Eritrea and Somalia who sunk and drowned just two weeks ... view
  • 8 Oct 2013 in Senate: No; you are wrong there, it was somebody else. We cannot have that kind of stereotyping in a free and democratic country because it can be a source of a lot of problems. I want to support those who were wise enough to come up with this amendment. I am sure that Sen. Haji is looking into the future because he has been working in this docket; directly and indirectly, dealing with issues that touch on security, refugees and citizenship. We must begin to think about how one incident can be used as an example to deal with future events ... view
  • 3 Oct 2013 in Senate: Mr. Deputy Speaker, Sir, I think this is an important point for consideration, not in relation to the Order Nos.8, 9 and 10, but generally in relation to the question of when a seat becomes vacant, because I think it is the assumption by the Clerk that the seat for the Senator for Bungoma County--- view
  • 3 Oct 2013 in Senate: Mr. Deputy Speaker, Sir, I think you have answered my question. The only problem is that it could not have been an oversight because--- view
