The functions of the CEO vis-à-vis the functions of the board members should be clearly spelt out. You have some boards where the members effectively become the organization and the CEO and others are just in the periphery. Looking at the Kenya Medical Supplies Agency (KEMSA), that balance must be worked out very carefully. Mr. Temporary Speaker, Sir, because of these experiences, and Sen. Farhiya and Sen. Suffice to say that the effect of the enactment of this Bill will be the revocation of the guidelines, which are in place. I think that is a good thing. Again, those guidelines were for the benefit of the National Treasury and the Executive.

Mr. Temporary Speaker, Sir, the other thing that will be repealed is Section 18 of the Public Finance Management Act. That is good. We should look at more carefully what Section 18 is saying. Where there is some relationship between the Public Finance Management Act and the Equalization Fund, we should make it very clear in the provision of this Bill that where there is conflict, the Equalization Fund Bill, when it becomes an Act, should prevail. Mr. Speaker, Sir, since you had said that we have very limited time which is five minutes, I am rising on the foot of Sen. Wambua. He was a member of the Committee. He probably knows more than we do because we have only the report to go by. If there are any factual contradictions, the Mover can react to them when replying. However, if every time somebody says something another stands up and says that it is wrong when the whole evidence is not here--- They should have carried the books here.

Sen. M. Kajwang’ has also reminded us that we have been appropriating, if that is the right word, funds to go to this project. When it comes to making accusations, we also stand accused. The Executive also stands accused. If I look at this project, it is more than Kshs38 billion. We should have been told that there was some Cabinet approval of a project of this magnitude.
