The principal Act provides for the regulations in Section 46. Hence Clause 29 will lead to duplication. What has been proposed by the Mover of the Bill is already captured in the principal Act. Therefore, we are proposing the deletion of Clause 29F because it is already there.

in Kwale Sugar Company where they are using modern technology, the cost of production is extremely low there. When you look at the cost of producing one tonne of cane in Kenya, it is almost US$22 compared to the rest of the region, where it is US$13. There was also purported export of sugar. We cannot blame the management of Mumias Sugar Company. On the basis of “willing buyer, willing seller” principle, the extra tonnes of sugar were bound for export. At the point of exit, there was collusion between the Kenya Revenue Authority (KRA) and those purported exporters whereby, the same sugar was being dumped back in the country.
