The question that we need to determine is at what point is a Bill considered to have been introduced in the National Assembly. First Reading of the Bill introduces the Bill in the National Assembly. That can only be done in accordance with Article 114 of the Constitution which requires that money Bills can only originate from the National Assembly, but not from the Senate. So, if some of the Bills that have listed for First Reading turn out to be money Bills, then certainly they cannot be introduced for the First Reading because they have come from the Senate. ...

Allow me to mention something that I mentioned outside Parliament because it is important. I was misunderstood when I said it. The Clerk of the Senate did not understand me well or what was reported by the media was wrong. The Office of the Clerk of the Senate needs to advise the Senators accordingly when they are introducing Bills, so that we do not get into this kind of circus. there is a war between the two Houses. The Constitution is clear. A money Bill cannot originate from the Senate. The Constitution is clear that the Senate only exercises oversight role on that portion of money that is allocated to counties. Any money that is allocated to the national Government cannot be overseen by the Senate. Senators call witnesses from national Government institutions to account for revenue that is allocated to the national Government, but not to a county government. I went to school reasonably well. Yes, Hon. Speaker, I want to also make some comments. I think what Hon. T.J. Kajwang’ has raised are two fundamental issues regarding whether it is appropriate to have this Motion before us. He has raised the concern of whether we have a Committee of Ways and Means. The question he is asking is whether we have established the committee as a House. Article 124 of the Constitution clearly says that Parliament has to establish a Committee of Ways and Means. So to me, that is the fundamental question that he is asking. The Standing Order says “once the House has resolved”. It does not say that the President has assented to it. It says we have resolved affirmative or negative. So, are we going to make another resolution within six months, before the six months end? I know that resolution can occur with the concurrence of the Hon. Speaker. If he gives the go ahead for that to be made, it is fine, but it should be explicitly clear that the National Assembly has expressly allowed this House to make another resolution on the same issue.

So, Hon. Speaker, as you consider the issue of Hon. T.J. Kajwang’ with regard to those two fundamental concerns, I would also urge that that is also incorporated. This is so that we do not have a situation where we are in confusion on which law to apply in the interim period. I know once we deal with the Finance Bill, everything will be clear. We shall sort out this mess that we are in today. This is the price to pay.
