The other thing is about planning by the Government. For the first time in the history of this country, in two consecutive years, we are going to have two Supplementary Budgets. That is a clear reflection of a Government that is not committed to proper planning. On planning, by the end of the last financial year in June, we had over 1,000 projects running, which cost about Kshs3 billion which can be translated to the current cost of about Kshs4.5 billion. Hon. Temporary Deputy Chairlady, I want to support the deletion of this clause for two reasons. We made a decision to have counties answerable in managing public land and that will be possible if you have the county land boards committees in place. I want to disagree with the Chairman who has said that the fact that the county assemblies approve the membership of the board gives them power to control them. That is not true. The law mandates the NLC to liaise with the county governments in appointing the boards. The responsibility of the county assemblies is the same ...

I support the amendment. Why? I thought the Committee was supposed to help us bring clarity to the various land laws we have. They have not done that. If you look at the Constitution, it is clear that under Article 67(2)(b), the function of the NLC is to recommend. The words to note there are “to recommend” and not “to make” or “to provide” a national land policy to the national Government. That can be the CS. No, Hon. Temporary Deputy Chairlady. Actually, I have the Constitution in front of me. I thought we need to look at Article 68 of the Constitution and, maybe, have Hon. Mlolwa base his argument on what we have read. This Article talks about the minimum acreage and maximum land holding. That is a big thing under that Article: Reviewing the manner in which land may be converted from one category to another and to regulate the protection of matrimonial property and to protect, conserve and provide access to all public land. I have difficulties supporting this amendment. First, knowing Kenya as it is, if you give so many days to people who own land or proprietors an opportunity for changes to be made, they will go to court and nothing will happen. They will always talk and block some amendments for changes to be made. So, I do not agree that this is something desirable. Secondly, the Chair was a bit economical as he has only explained part of his amendments.
