  • 23 May 2012 in National Assembly: Mr. Deputy Speaker, Sir, this matter has been outstanding for quite some time now. I am not so sure that the Assistant Minister is sure of resolving the matter within a week. Therefore, I would ask him to take two weeks and deal with the matter exhaustively because the law governing pension payments in this country is very clear. Nobody has a right to stop the payment of anybody’s pension. Even if that person owes the Ministry money, the law, which was amended in 2005, is very clear that pension has to be released to the recipient. It cannot even ... view
  • 23 May 2012 in National Assembly: Mr. Deputy Speaker, Sir, I would ask the Assistant Minister to take two weeks, so that he can come back and address this matter properly. view
  • 23 May 2012 in National Assembly: Mr. Deputy Speaker, Sir, thank you for your ruling. However, having noted that this is a matter that is weighty in terms of constitutionality, could I, therefore, ask the Chair to specifically rule--- This House set up a Committee called the Constitution Implementation Oversight Committee (CIOC). The task of that Committee is to ensure the constitutionality in the implementation process of the Constitution. Therefore, would it be in order for me to ask the Chair to specifically ask this Committee to investigate this matter and do a report to this House within a time line, so that the matter is ... view
  • 23 May 2012 in National Assembly: On a point of order, Mr. Deputy Speaker, Sir. Is it in order for hon. Midiwo to walk out from the House when his question is being addressed? view
  • 23 May 2012 in National Assembly: Mr. Deputy Speaker, Sir, let me, first of all, thank and congratulate our Defence Forces for a job well done in Somalia. I just wanted to say that up to November, when we were fed with the information--- view
  • 23 May 2012 in National Assembly: Mr. Deputy Speaker, Sir, I have just thanked and congratulated our Defence Forces for a job well done in Somalia. Up to around November, if I am not wrong, when we were fed with the information about the progress, I think Kenyans appreciated and continue to appreciate the work that our Kenya Defence Forces have done in Somalia. But the clarification I would like to seek from the Prime Minister is: What is the policy of the Government with regard to this operation, especially given that what we are seeing internationally, is the Americans withdrawing from Afghanistan and Iraq? What ... view
  • 22 May 2012 in National Assembly: On a point of order, Mr. Deputy Speaker, Sir. I really do not understand the constitutionality of what the Chairs of various Departmental Committees are doing. This is because the Constitution in Article 221 is very clear on how the Estimates are supposed to be considered. Article 221 (3) states thus: “The National Assembly shall consider Estimates submitted under Clause (1) together with Estimates submitted by the Parliamentary Service Commission---” Article 221(4) states thus: “Before the National Assembly considers the Estimates of Revenue and Expenditure a Committee of the Assembly shall discuss and review the Estimates and make recommendations to ... view
  • 22 May 2012 in National Assembly: On a point of order, Mr. Deputy Speaker, Sir. Many times, the main reason why Back-benchers ask Questions in this House is because of failure by the Executive to perform. If the Executive was doing its work properly, there would be no reason for Questions. Mr. Wamalwa was very effective when he was in the Back Bench. I really do not know what happens to hon. Members when they cross over to the Government side. I want to remind him that as effective as he was when he was this side, we would request him to be effective the other ... view
  • 22 May 2012 in National Assembly: So, I urge him to just address this Question today because he is capable. view
