asked the Minister of State for Public Service:- (a) whether he could state why public servants, including teachers working in Suba District, have not been paid hardship allowance as earlier promised by the Government following classification of the district as a hardship area; and, (b) when payment of the allowance will be implemented.

12 Oct 2010 in National Assembly:
Mr. Speaker, Sir, the answer by the Minister surprises me because he talks of paying the hardship allowance, possibly when we receive budget allocation during the Supplementary Budget and then he goes ahead to say that for the teachers, the collective bargain agreement which was signed has to continue. In which case, the Minister is telling us that the teachers will not receive hardship allowance yet other public servants who work in the same area will receive the allowances. 12 Oct 2010 in National Assembly:
Mr. Speaker, Sir, I am still pursuing the issue of teachers. I would want to know - the Ministry is responsible for the welfare of all public servants - why the Ministry will not pay hardship allowance to teachers in Gwassi, Mbita and Nyatike, which were classified as hardship areas in the report the Minister gave just because KNUT has objected to the removal of other areas. On a point of order, Mr. Temporary Deputy Speaker, Sir. Given the manner in which the Assistant Minister has treated this matter, and the fact that Mr. Fred Odhiambo has no capacity to be present in this House to defend himself and his job is on the line, would it be in order for me to ask the Chair to refer this matter immediately to the relevant committee for consideration? It is a very serious matter. The Assistant Minister is not explaining any offence that Mr. Odhiambo committed, yet Mr. Odhiambo has no job today.

7 Oct 2010 in National Assembly:
On a point of Mr. Speaker, Sir. I am just rising to add my voice to the point of order that has been raised by Dr. Khalwale. If you read the transition and consequential provisions, Article 261(4), it says: âFor the purposes of Clause 1 â clause 1 talks about enacting legislations that are required by this Constitution â the Attorney- General, in consultation with the Commission for the Implementation of the Constitution, shall prepare the relevant Bills for tabling before Parliament as soon as reasonably practical to enable Parliament to enact the legislation within the period specified.â
