Madam Temporary Deputy Speaker, I also want to take the hon. Members to Clause 12(6), which states that notwithstanding the provisions of subclause (5), the President may, for the purposes of filling a vacancy, select a nominee from the list of candidates forwarded by the Public Service Commission (PSC) under Clause 9(6). I want a clarification on this. Below Section 9(6), there is Clause 9(8) which gives Parliament the power to approve the nominations. Madam Temporary Deputy Speaker, I stand to oppose the proposed amendment. If you look at the recommendation which is proposed to be deleted, according to me, this is the core of this Report. It is true from the Report that Mr. Kimunya went to the Committee on 21st May and told the Committee that Grand Regency Hotel had not been sold yet on 8th of the same month, which is two weeks before, the Central Bank of Kenya had already received part payment for the hotel. Madam Temporary Deputy Speaker, yesterday I listened attentively to Mr. Kimunya trying to explain why he took the position that he took when he presented himself before the Committee and I realised that he decided to jump from being an accountant to a lawyer by insisting that he felt that the hotel had not been sold by the mere fact that the transfer of title had not been made.

Mr. Kimunya is a reputable accountant having been the chairman of the Institute of Certified Public Accountants of Kenya (CPAK). Mr. Kimunya should have known that in accounts, the moment you receive money for sale of an asset, you will automatically, in your books, credit the asset account. You will debit your account with money and treat any money outstanding as receivables. In which case, as accountants, we deal with the substance and not the legal form. Mr. Temporary Deputy Speaker, Sir, I do not have a problem with the hon. Member because I know that he was in his constituency just recently. We had some very nice treatment there and I witnessed that he was there. I want to find out from the Minister about the boreholes that she is talking about. Most of the boreholes that were dug by the Lake Basin Development Authority in the early 90s are not working. Does the Ministry have in place a mechanism of servicing these boreholes, so that they are in a working condition?
