  • 17 Aug 2010 in National Assembly: Mr. Temporary Deputy Speaker, Sir, I beg to move that the House doth agree with the Committee in the said Resolution. view
  • 1 Jul 2010 in National Assembly: On a point of order, Mr. Temporary Deputy Speaker, Sir. This is a good Bill but it has been presented to this House in the wrong way. Section 40 of our Constitution is the source of my point of order because the Bill is calling for the establishment of an institute called “Malaria Institute”. To establish an institute, you need money. So, this Bill is proposing to appropriate money although the Mover wants to get this House to believe that there is no financial implication. Section 48 of the Constitution says:- “Except upon the recommendation of the President, signified by ... view
  • 1 Jul 2010 in National Assembly: “(i) proceed upon a Bill including an amendment so that the Bill in the opinion of the person presiding makes provision for any of the following purposes---“ The purposes are stated. Therefore, is it in order that even this debate should proceed when in fact, the whole section is infringed, even though there is a misleading statement that there is no financial implication when an institute will probably cost millions of shillings? Is it sufficient for the Mover just to say that there will not be implication and the House just takes it like that when the Constitution is very ... view
  • 1 Jul 2010 in National Assembly: Mr. Temporary Deputy Speaker, Sir, if you look at our financial regulations, you will find that the fees collected at any Government institution are regarded as Appropriations-In- Aid (A-in-A) which are apart of public funds. That is to say that you cannot use public funds to build an institute, or use some money collected from an institute because of the services it offers and pretend that those are not public funds. The very fact that it is not monies voted here does not disqualify fees paid from being public funds. I am sure that our financial regulations are very clear ... view
  • 29 Jun 2010 in National Assembly: Mr. Speaker, Sir, I beg to reply. I wish to confirm that the United Nations has asked developed countries to make concerted efforts to address issues of climate change. The United Nations, through the United Nations Framework Convention on Climate Change, did have a meeting in Copenhagen last year. I want to confirm that the meeting did not end well, in that the agenda for the meeting was never concluded at the technical level. Therefore, there was no report to be considered by the conference of parties No.15, neither was there a report that had been finalized for consideration by ... view
  • 29 Jun 2010 in National Assembly: Mr. Speaker, Sir, the draft regulations to control the emissions from vehicles and industries and so on have actually been on my table for quite some time. The issue is not so much that we lack regulations, but rather that we lack the capacity to enforce them. From the governance point of view, it is ill advised to introduce a law which you cannot enforce. view
  • 29 Jun 2010 in National Assembly: Mr. Speaker, Sir, the Kenya strategy to face problems of climate change is a document that was produced after very close consultations with the private sector, provinces and district committees that are mentioned in the Act. Those who have read that document have seen that we have programmes for the Ministry of Agriculture, Ministry of Energy, Ministry of Water and Irrigation and the Ministry of Forestry and Wildlife. We have those areas that are mentioned within the Vision 2030 that will bring change and produce sustainable development. We have estimated that we would need over US$2 billion a year to ... view
  • 29 Jun 2010 in National Assembly: Mr. Speaker, Sir, there are two important documents to guide this House and the country on the issues that we have to deal with. I have just referred to one as the climate change strategy that we have published. There is another document which we have published and we have supplied this document to some Members of Parliament. We did this in Mombasa. That is the atlas of our changing environment. If the hon. Member would refer to page four of that document, he will see what all of us are expected to do. At the end of the day, ... view
