Hon. Temporary Deputy Chairman, I understand the thinking that we want the capacity building to be done in the constituencies. That is in agreement. But I would propose that the best way to do it, instead of deleting this part--- Really, we want to have the same standard for Uwezo Fund. Uwezo is one thing; we cannot have 290 versions of Uwezo with the same curriculum for capacity building, with the same materials. So, I would rather we amend and say, that in consultation with the committee, the Ministry has the responsibility to set the standards on curriculum for capacity ...

Thank you, hon. Temporary Deputy Chairman. I want to concur that hon. Millie Odhiambo’s constituency might not need the same amount of money as hon. Simba Arati’s for capacity building. She might need more because of the communication challenges. What I am saying is this: Also, if you look at the economies of scale, in as much as the capacity building will actually be done at the constituency level, once we let the Ministry set standards, they might actually come together with other constituencies in a county through those committees. If we break it down to constituencies having equal and ...

Thank you, hon. Deputy Speaker. I just want to make one or two comments on this Bill cognisant of the fact that it is one of the Bills that have a timeframe within which they must be passed. I would just like to appeal to the Committee, and I speak as the chairman of a political party and a big political party at that, to kindly involve political parties as key stakeholders in this matter. Political parties have not been consulted at all. Even written submissions from political parties, especially on practical elements of this Bill should be forwarded to ...

Thank you very much, hon. Speaker. I want to start by quoting one Thomas Penn, who stated: “A body of men holding themselves accountable to nobody should be trusted by nobody.” Hon. Speaker, I am not an Advocate of the High Court like hon. Kaluma and the rest but I am a good student of law. I understand that the doctrine of separation of powers, for a long time, has been misconstrued and misused. It has become a veil for institutions whenever they want to go against the Constitution. Again, I quote Albert Venn Dicey, writing in 1915. These problems ...

We are law makers. Read the Constitution once in a while. When you talk about thresholds, the work of this Committee was not to determine guilt or innocence on the part of the JSC. At a prima facie level, it was just to determine if there was substantial ground for the formation of a tribunal where now the members of the JSC--- In fact, I think a few of them are my friends. I have nothing against the individuals, but the institution itself must be run in the right way; it must follow the rule of law. The question is: ...

Thank you, hon. Speaker, Sir. I rise on two points of order. You have already ruled on one, that if a Member feels that a matter is sub judice, according to Standing Order 89, he needs to show how the discussion of that matter will prejudice its fair determination. I do not think that has been shown. I also rise on Standing Order 95, that for the past four weeks hon. Members have expressed themselves on this matter and judging the mood in the House, would I be in order if I suggest that the Mover be now called upon ...
