Thank you, Mr. Deputy Speaker, Sir, for giving me this opportunity to say a few words about the President's Address yesterday. Mr. Deputy Speaker, Sir, among many things that the President talked about and, indeed, what some of my colleagues have just been addressing, is that the President, in his Address, appeared to place some value on dialogue. He emphasised that there is need for dialogue for us to be able to agree on the way forward, particularly on the issue of constitutional review. Mr. Temporary Deputy Speaker, Sir, I must say that the President did appreciate the critical or crucial role played by the watchdog committees of the House. However, I must say that those committees make recommendations year in, year out, which are not being implemented. Indeed, when we find flagrant violations of procurement laws and we raise the flag, what we have seen in the recent past is Ministers of Government standing up to defend those positions. Mr. Speaker, Sir, as you are aware, this matter was discussed in the House Business Committee. None other than the Deputy Leader of Government Business was actually urging that the Statute Law (Miscellaneous Amendments) Bill be dealt with yesterday and not today. Now, she says that there are new matters which have come up. We want honesty. What we say elsewhere, we should also say it here. I think this is not fair.

On a point of order, Mr. Temporary Deputy Speaker, Sir. Is it in order for the Minister for Justice and Constitutional Affairs to stand here and argue that the Government of the day, to which she belongs, does not have a responsibility to uphold the law when it is, on a daily basis, interfering with the running of the affairs of political parties, for instance, appointing Ministers without following the due course of the law?

Mr. Temporary Deputy Chairman, Sir, on behalf of Mr. Moi, I beg to move:- THAT Clause 10 be amended- (i) in paragraph (e) by inserting the words "in consultation with the private sector" after the word "Minister". (ii) by numbering paragraphs (d) and (e) as (c) and (d). The amendments are found on page 584 of the Order Paper. This is on behalf of the Departmental Committee on Energy, Communications and Public Works. I think it is a matter that has been discussed with the Ministry.

Mr. Temporary Deputy Chairman, Sir, on behalf of the Departmental Committee on Energy, Communications and Public Works, I beg to move: THAT, Clause 30(1) be amended by inserting the following new paragraph- "(k) provided that the Commission will take into consideration the achievement of national strategic goals formulated for the energy sector from time to time. Looking at what is proposed to be inserted, I feel that in exercise of my limited discretion in matters of public policy, this amendment does not make sense.
