Mr. Temporary Deputy Speaker, Sir, I think what is appearing on the Order Paper as Order No.7, dealing with the need to prioritise what is going on at the Port of Mombasa is a matter of great importance. Muundo July 1, 2008 PARLIAMENTARY DEBATES 1493

that is, infrastructure is a very serious matter. Since this matter has already been brought before this House and debate on it commenced, I want to urge that we continue. What is appearing here is that we have to continue with debate on a matter that we had started debating. However, Mr. Temporary Deputy Speaker, Sir, this is a matter which is clearly the property of this House and the Leader of Government Business might want to be guided by the mood of the House. However, in view of the fact that we need to give priority to the development ...

On a point of order, Mr. Speaker, Sir. We wish to urge that the Chair re-considers its ruling on this matter, purely on the basis that it is a Constitutional requirement, including the fact that His Excellency the President has to signal his consent to this matter. As the hon. Member for Ugenya and Minister for Lands eloquently pointed out, there is no way the President will have given consent to Mr. Imanyara's amendment of the Motion. Mr. Speaker, Sir, the very fact that there is no schedule--- It is really all set out there; it is a 1422 PARLIAMENTARY ...

On a point of order, Mr. Speaker, Sir. In view of the importance of the business before the House this afternoon, I want to suggest that rather than debate this amended Motion, the Houses goes straight to vote on it so that, we can go substantially to the main item. It is a point of order because we have the three hour limitation.

Mr. Speaker, Sir, I oppose this Motion of amendment in the strongest terms possible. In order to make progress, I urge that this House does not send the wrong signals to a nation that is clearly beginning to heal, to the people in the IDP camps, where some of them feel that we are sending mixed signals. If we want to cut down this figure to the one that Mr. Imanyara's Motion suggests, the message you are sending to the people, and, in fact, to investors, is that you are not sure about the future. This House is sending wrong ...

Mr. Speaker, Sir, in accordance with the provisions of Standing Order No.22, I beg to move the following Motion:- THAT, this House do now adjourn until tomorrow in the afternoon when we come to listen to the Budget Speech. Mr. Speaker, Sir, this Motion is enforced by the sobering reality that faces our country today following the untimely death of two of our colleagues in the plane tragedy to which you have already referred in your Communication from the Chair. Although I had occasion to send my message of condolences, I thought that this morning all of us could stand ...

Mr. Speaker, Sir, I appreciate Mr. Linturi's concern. However, in terms of legality, I do not think a letter of appointment is as fundamental as the Assistant Ministers having been sworn in. Therefore, the matter of appointment letters, if, indeed, they have not been issued, is really a matter on course. The fact that they are sworn in as Assistant Ministers, they are able to answer Questions in this House.

Mr. Speaker, Sir, further to what the Senior Counsel has said, is it really in order for our colleagues to insist on a matter that is so clearly spelt out in the Constitution itself? The Constitution is the supreme law of the land. I want to refer the House to the provisions of Section 21 of the Constitution. I quote:- "A Minister or an Assistant Minister shall not enter upon the duties of his office unless he has taken and subscribed to the Oath of Allegiance and such oath for the due execution of his office as may be prescribed ...

Mr. Speaker, Sir, Mr. Muriithi was duly appointed and sworn-in as an Assistant Minister in the Ministry of Industrialization. In that capacity, he was answering the necessary Question. Mr. Speaker, Sir, I want to let my learned friend, Mr. Imanyara, know that the information that I have is that the Presidential Circular was taken for printing today.
