Before we issue the TOL, we would have to get authority from the Ministry of Roads to utilize that land. As I said, the first steps are in place and the procedures are being followed. The tender has now been approved and awarded to M/s Kenyash Inter-Business Enterprises Limited for Kshs12,116,420.40. A letter of award was issued on 29th February 2012 requiring the contractor to provide a performance bond of 5 per cent in the form of a bank guarantee. The notification of award was sent to M/s Kenyash Inter- Business Enterprises Limited through P.O Box address 23606-00625, Nairobi, which the contractor confirmed was wrong and hence the delay in receiving the notification award.
