Madam Temporary Deputy Chairlady, when the Constitution itself invites us to legislate further, what is it asking us to do if we are to confine ourselves to the argument that whatever the Constitution has set out, that is it? We are supposed to give flesh to the Constitution. The Constitution can only give us the principles and boundaries of the broad aspects. It is for us now to do the details. Madam Temporary Deputy Chairlady, I am a Member of the Committee and the thinking here relates to the earlier one. If this Commissionâs sole purpose is to help us in formulation of legislation, how does it help any of their members? What advantage would it give to any of the members in terms of an electoral position? One can understand the argument about the Electoral and Boundaries Review Commissions where you can see that there is conflict of interest in the sense that they may curve out something that might be advantageous to themselves. If you look at the Schedule, particularly No.28, it asks: Have you ever been charged with a criminal offence in a court of law? So, it does not matter what we are doing today; if you were acquitted, it now becomes part of a record whereas my understanding of jurisprudence has been, it is a conviction which forms part of the record. Mr. Deputy Speaker, Sir, I appreciate the Ministerâs answer with regard to what the Ministry is doing. He is doing a good job, but I would like him to change to a user system like the one used for CDF funds. There are some areas which are more needy than others. There are some areas which have better roads than others. There are some constituencies which are bigger than others. So, instead of giving a uniform figure of Kshs27 million, he should create a formula where he allocates funds according to the needs and the size of each constituency.

Mr. Speaker, Sir, I beg to ask the Minister for Education, the following Question by Private Notice. (a) Is the Minister aware that the Kenya Primary School Head Teachers Association (KEPSHA) held an Annual Conference in Mombasa between 3rd and 8th October, 2010? (b) Could the Minister explain why the Ministry allowed the Kenya Primary School Head Association (KEPSHA) to hold the annual conference while they should be in their respective schools to prepare pupils for the KCPE examination? (c) Will such a meeting affect the performance of the KCPE examination and end of year examinations for all classes?

Mr. Speaker, Sir, the point I want to raise with the Minister is the following; At this time, students are preparing for exams. For them to be in the right mind, headteachers and all the other teachers are supposed to be in school to guide, help and counsel them so that they can prepare for exams. When headteachers leave and pupils know that they have gone to Mombasa, what comes up in the mind of a young person? What does the young person think about that; that the headteacher has travelled to Mombasa for a meeting? Finally---
