Mr. Speaker, Sir, I beg to ask the Deputy Prime Minister and Minister for Local Government the following Question by Private Notice:- (a) Could the Minister consider granting a waiver of interest and penalties on land rates to avert the loss of homes and businesses in view of the recent notice to defaulters by the Nairobi City Council? (b) Could the waiver be applied to all local authorities countrywide? I would also like to bring the Deputy Prime Minister and Minister for Local Government greetings from his home area which I toured yesterday.

Mr. Speaker, Sir, I would like to thank the Deputy Prime Minister and Minister for Local Government for that âtechnicallyâ correct answer. However, at the operational level, the answer leaves a lot to be desired. The Deputy Prime Minister and Minister for Local Government is in charge of policy. We are aware that most local authorities throughout Kenya, and especially Nairobi, suffer huge arrears of rates. The penalties that have accrued thereon make it impossible for premises owners to pay. Mr. Speaker, Sir, as a matter of fact, all local authorities are providing below par in terms of services. Therefore, strictly speaking, they have no good basis for collecting rates and anything else from the citizens. Secondly, there is rampant corruption everywhere and defaulting rates offers a window of opportunity to the corrupt. Mr. Speaker, Sir, the police handle criminal issues and not civil issues dealing with compensation. Could the Assistant Minister be specific and tell us when he will engage the families of the deceased so that they can be compensated, without claiming that the police are handling compensation issues?

Mr. Speaker, Sir, I want to thank the Minister for her answer, but also draw her attention to the fact that under Article 7(2)(d) of the Rome Statute, deportation or forceful transfer of population is a crime. Those who brutalized populations after the 2007elections intended to forcefully get them out of their homes and they managed. When the Government adopts a policy of resettling them outside the areas where they were, it is being complicit in the offence of deportation. On a point of order, Mr. Speaker, Sir. I asked a specific question based on Article 7(2)D on deportation. I specifically said that the Government is aiding and abetting deportation. This is because if you are from one area and you have been expelled due to violence and the Government goes and settles you elsewhere, it is aiding and abetting the original crime. Is the Minister in order not to answer that very specific question? Why can they not find farms in the areas those people came from, so as not to aid and abet deportation?

asked the Minister of State for Provincial Administration and Internal Security:- (a) whether he is aware that a contingent of Administration Police officers trespassed onto private property that is subject of a court dispute, namely, Narok/Nguruman/Kamorora/1, in April, 2010, and have remained there since, despite protests by the registered owners; and, (b) whether he could order immediate withdrawal of the police from the property.
