Mr. Speaker, Sir, I beg to ask the Minister of State for Provincial Administration and Internal Security the following Question by Private Notice. (a) Is the Minister aware that Mr. Joseph Kinyua Marui disappeared in Mt. Kenya Forest where he had gone to graze cattle on 26th October, 2011 and has not been traced since? (b) What efforts is the Government making to ensure that the said person is traced?

Mr. Speaker, Sir, while thanking the Assistant Minister for that answer, I am a bit disappointed that the only action taken was sending signals around the country. What is required in a case like this is a search party which should go into the forest where this man was. Is the Assistant Minister prepared to organize a search party, so that the family may be able to ascertain whether this man is alive or whether harm came upon him? Mr. Speaker, Sir, I want to appreciate the Assistant Minister’s commitment to conduct a search, but I would want his assurance that in future in cases of this nature, immediately a disappearance is reported a search will be mounted without any delay to aid the family of the person who will have disappeared. Otherwise we are devaluing the citizenship of our people. There must be some value in being a citizen.

Madam Temporary Deputy Speaker, I want to, first, commend the Committee, I wish they went a little bit further and moved this House to stop all demolitions until there is a policy on demolitions. I am hoping that before the conclusion of this debate, an appropriate amendment to that effect will come up. I think the Committee tried within the time and the means they had. I want to refer to one of their observations that there were court cases between the Kenya Airports Authority and the residents of these places before the demolitions. I am not misleading and I think if he means it as a point of information, he is welcome. I would not agree even with the Attorney-General. There is nothing wrong with the law. There is something very wrong with the enforcement. If you want to know how correct that is, we have a new Constitution. Why are people being evicted in a worse manner than under the old Constitution? This has nothing to do with the law. It has something to do with attitude. On a point of order, Madam Temporary Deputy Speaker. I do not hold brief for hon. Waititu, but I think that the House will need your guidance. A Member has tabled documents which speak for themselves. So, if any other Member says they are not what they are, the onus then will be on that Member. However, to ask a Member who tables a document, to do something technical, like saying the location and other technical things, it will set a dangerous precedent. We shall never be able then to table documents unless the ones we have authored.

(a) Is the Minister aware that Kenneth Muchiri Muriithi, a Form III student at Kiine Mixed Secondary School in Mara District, disappeared on 7th September, 2011 and has not been traced since? (b) Was a report on the disappearance made to the police by the School and, if so, when? (c) What is the Minister doing to ensure the whereabouts of the student is established?

Mr. Temporary Deputy Speaker, Sir, you have heard that unfortunate statement from the Assistant Minister “where the student is hiding”. This is a boy aged 17 years, in Form III and, therefore, he is a minor. He was in a boarding school and disappeared from a boarding school where the parents entrusted him to the school authorities.
