  • 18 Mar 2015 in Senate: Mr. Temporary Chairperson, thank you for arguing my case. Standing Order No. 136 talks about sequence to be observed on a Bill in Committee of the Whole. It states the following: “In considering a Bill in Committee of the whole, the various parts thereof shall be considered in the following sequence:- (a) clauses as printed, excluding the clauses providing for the citation of the Bill, the commencement, if any, and the interpretation; (b) new clauses; (c) schedules; (d) new schedules; (e) interpretation; (f) preamble, if any; (g) title; and, (h) the clause providing for the citation of the Bill.” view
  • 18 Mar 2015 in Senate: Mr. Temporary Chairman, I am not trying to validate anything. However, we are paying fidelity to the law and the Standing Orders. We agree that you are starting a tradition that is veering away from the beaten track. The correct thing to do is what the Standing Orders say. • 18 Mar 2015 in Senate: On a point of order, Mr. Temporary Chairperson, Sir. Allow me to speak on behalf of the Chairman of the Committee on National Security and Foreign Relations to which I belong. The Chairman inadvertently indicated to the Chair that he was withdrawing all the amendments that came from the Committee. Upon consultations with the Senate Majority Leader, we believe that these amendments are merited. Some are aligning the Bill with devolution. Clauses in the Bill that are referring to districts which are no longer in existence are to be amended to talk about counties. I would request that after dealing ... view
  • 18 Mar 2015 in Senate: On a point of order, Mr. Temporary Chairman, Sir. What the distinguished professor is saying is that even as we seek leave to report progress at the next sitting, he should not be called upon to prosecute this amendment, we simply vote on it because he has already prosecuted it, which I think is a fair request. You just postpone the vote on Clause 8 which the distinguished Professor has already moved and the House has concurred by conduct except for the vote. view
  • 17 Mar 2015 in Senate: Mr. Speaker, Sir, you heard the Chairman tell us, and you could see from his demeanor that he did not even appear to believe in what he was saying; that our forest cover is 6.9 per cent. This is a big joke. The forest cover in Kenya has never been 2 per cent in the last more than 20 years because of the destruction of forests. Could he tell us where these forests are, what acreage they are and how he has arrived at a percentage of 6.9 out of our 583,000 square kilometres land mass in this country? That ... view

  • 17 Mar 2015 in Senate: Mr. Speaker, Sir, I made no allusion to misdemeanor. The demeanor of the distinguished Senator for Embu, whom I have tremendous respect for and liking---For your information, we were at the university at the same time. He lived in Room 137, while I was in room 138 in Hall 10. He has been my friend ever since. I simply said that looking at his body language as he spoke, he did not even appear to believe in what he was saying. That was my impression. • 17 Mar 2015 in Senate: Mr. Speaker, Sir, Article 96(1) of the Constitution states that:- “The Senate represents the counties, and serves to protect the interests of the counties and their governments.” The county governments have two arms, the executive and the assembly. If we have to discharge this mandate, we should avoid any situation where we fall into a trap and be part of the connivance to capture county assemblies by the executive because he who pays the piper calls the tune. • 17 Mar 2015 in Senate: On a point of order, Mr. Speaker, Sir, I have a request that will require a response and clarification from you. Over the weekend, there were screaming headlines about a statement attributed to the Speaker of the National Assembly. This statement purported to indicate that a letter conveying a warning to the Speaker of the Senate had been written by the Speaker of the National Assembly with regard to the provisions of Article 261(5) of the Constitution. The Speaker of the National Assembly seems to operate under an illusion that he can direct, warn, or intimate the Speaker of the ... view
  • 17 Mar 2015 in Senate: Mr. Temporary Speaker, Sir, I want to thank Sen. Billow for bringing this Motion of Adjournment. I recall that this is not the first time he has brought this Motion. Mandera is bleeding and ailing. When I was a young lawyer in 1993, I went to Mandera to defend somebody falsely accused and the magistrate was a District Commissioner (DC).This man told the DC that “we in Mandera are not in Kenya, we are not Kenyans and we are not treated as such”. Being a young inexperienced lawyer, the DC ignored all my pleas and jailed the man with no ... view
