  • 17 Jun 2010 in National Assembly: What the Minister, I think intends to call the lesser offences, where he is giving, if you look at Clause 20, a prescription of sentences of Kshs500,000 as the maximum and ten years as the maximum. Again, what I said on the other sentences apply. Clause 22 of the Bill worries a bit because the Minister is trying to give himself a discretion that is unfettered where he says: “Where the Minister has reasonable grounds to believe that a specified group is engaged in any organized criminal activity under Section 3, he may, by notice, declare that specified group an ... view
  • 17 Jun 2010 in National Assembly: Mr. Temporary Deputy Speaker, Sir, on the whole, as I come to my conclusion, I fully support the Bill. It is long overdue and it should be improved in the terms that I have suggested. I am sure many more of our colleagues will suggest focusing on economic crimes and other crimes of an organized nature. The sentences must be stiff. Above all we, as leaders, must all be on the front line of speaking candidly and openly against organized crime because it has led to many of our young people into jail in China, Iran and many places. I ... view
  • 17 Jun 2010 in National Assembly: With those many remarks, I strongly second this Bill. view
  • 15 Apr 2010 in National Assembly: Mr. Speaker, Sir, I beg to reply. (a) The role of Ambassadors and High Commissioners is defined by the 1961 Vienna Convention on diplomatic relations. Specifically, Kenya’s ambassadors and high commissioners serve as the Heads of the diplomatic missions and personal representatives of the Head of State in the countries of accreditation. They promote, project and protect Kenya’s image and national interest and promote cordial relations between Kenya and the country or institution of accreditation. In this case, institutions like the AU and the UN. The persons appointed as ambassadors and high commissioners serve at the pleasure of the appointing ... view

  • 15 Apr 2010 in National Assembly: (c) Appointment to the grade of ambassador extraordinary and plenipotentiary is made in accordance with Section 112 of the Constitution of the Republic of Kenya which states as follows:- view
  • 15 Apr 2010 in National Assembly: “The power to appoint a person to hold or act in the office of ambassador, high commissioner or other principal representative of Kenya in another country and to remove from office a person holding or acting in any such office shall vest in the President.” view
  • 15 Apr 2010 in National Assembly: Mr. Speaker, Sir, a recall of an ambassador or high commissioner is not accentuated by any offence as the hon. Member is insinuating. Ambassadors and high commissioners are appointed and are posted to serve in stations and they may, midstream, be relocated to other stations or be recalled back to serve the Government in different capacities. Even where an ambassador may be in the process of being moved from one station to another, the correct procedure is to recall before the designation to another station is done. So, there are some who have served much longer than others while there ... view
  • 15 Apr 2010 in National Assembly: Mr. Speaker, Sir, my good friend here has asked me that question in the Committee and he repeats it here. First, when ambassadors are appointed and posted, there is no fixed term. They are appointed and posted to serve the country. There is no provision in any law for any fixed term for an ambassador. Secondly, Amb. Nzomo very diligently and ably served this country for six good years in Zimbabwe and Geneva. So I do not understand what my colleague means by cutting short her term. Thirdly, as to Amb. Odembo, he was appointed and posted to Paris and ... view
  • 15 Apr 2010 in National Assembly: Mr. Speaker, Sir, Amb. Odembo is our extraordinary and plenipotentiary in Paris. He has been recalled! I am not the appointing authority and I have made it very clear that an ambassador can be recalled in transit to another station. Unless an appointment to another station is done, I am not the appointing authority. Therefore, I am not obligated to speculate. view
