My Ministry, in an effort to enforce the marketing standards in the country and to ensure uniformity countrywide, issued guidelines in the Kenya Gazette Supplement No.64 of 5th September 2008. A detailed schedule that covers 41 agricultural produce was published. The maximum weight permitted for a bag of potatoes, both red and white Irish, is 110 kilogrammes. Mr. Deputy Speaker, Sir, it is, indeed, unfortunate if enforcement officers are not following the law. However, the gazette notice and the guidelines are very specific. If there is a specific case that may be happening in a specific area where there is serious laxity, I will be happy to get further information from the hon. Member so that these officers may be reprimanded. This should happen in an area where there is that kind of deficiency he is talking about. The laws and the guidelines are there and we expect the officers to follow them.

Mr. Deputy Speaker, Sir, I may not, at this point in time, give any specific indications of who has been arrested or arraigned in court. Because this focuses primarily around Ndaragwa and Molo, I will specifically follow up directly with the local authorities in these two areas so that this law can be enforced.

Mr. Deputy Speaker Sir, I wish to reiterate again that I will follow up this specific issue so that the law is enforced. However, I would like to say that, indeed, there is some good progress although it is not smuggling. The fact that our farmers from Molo and other areas are now exporting potatoes as a commodity should be seen in a very positive context. I wish to state as follows: It is true that the Gigiri fire station plot was earmarked for a fire station and allocated to the Council. Mr. Speaker, Sir, there is also the Imara Daima Fire Station. The land where Imara Daima falls was called Villa Franca. This was Government land. The Ministry of Lands did the structure plans and the NCC is not aware of any fire station and neither was it ever allocated land for a fire station in this area.

Mr. Speaker, Sir, first of all, I want to say with respect to hon. Mbugua, the fact of the matter is that the people who went to demolish the building in the Gigiri area is actually the City Council enforcement officers. That is what he did not acknowledge. They are the ones who are enforcing that particular order.
