Mr. Temporary Deputy Chairman, Sir, the effects of deleting sections 2 and 3 and leaving Section 1 is that from tomorrow banks will be free to charge any interest rates that they want to. That is what they did in 1993 and 1994. This destroyed the entire middle class of this country. We want the Minister to have this power. If he does not want it, a Minister in another Government will want it. We want to retain it. He may or may not use it. However, we must protect our people against mercenary banks in this country.

Mr. Temporary Deputy Chairman, Sir, we have seen situations where the Central Bank of Kenya (CBK), a Minister, Attorney-General or even the Chief Justice have been given power to stipulate certain guidelines, but they never implement them. So, we would never know when a non-performing loan becomes non-performing. Mr. Temporary Deputy Chairman, Sir, the amendment partly says:- "A loan becomes non-performing in such a manner as may, from time to time, be stipulated in the guidelines prescribed by the Central Bank." Mr. Temporary Deputy Speaker, I just want the Assistant Minister to note the following, which is happening in Suba District where Mbita Constituency is situated. First of all, a part of the district has been declared a hardship area and the teachers are getting their allowances. Teachers in another part, which is even "harder" in my view, do not get hardship allowance. Teachers are now moving from one part of the district to work in another part of the district, so that they can benefit from that allowance. That is one destabilizing factor. Mr. Temporary Deputy Speaker, Sir, I will talk about three aspects regarding the 8-4-4 System of Education that has been a disaster to a poor district like Suba, which is one the poorest districts in this country. The 8-4-4 System of Education came with another policy that states that you can only admit 15 per cent of the students from outside your district. This means that 85 per cent of the students who qualify to join secondary schools must be admitted in the secondary schools in their home districts. Mr. Temporary Deputy Chairman, Sir, mine is really a simple point. I am of the feeling that there are certain things which should not be enacted into law, for example, where a commission's headquarters should be located. I think that is a matter that will be decided by policy as and when the need arises. So, whether it should be in Nairobi or in the capital city, it is really not for the law. Mr. Temporary Deputy Chairman, Sir, just for clarification, it is not clear whether it is an authority, commission or board. I can see a lot of repetition. We have sentences such as: "Recommendation of the Authority, Chief Executive of the Authority and submitted by the Board". I am not sure which body we are dealing with.
