30 Aug 2007 in National Assembly:
Mr. Temporary Deputy Chairman, Sir, I was one of the people who talked in support of hon. Ms. Karua that this amendment that was sought by my friend did not talk about the source. In fact, I was very surprised in the evening while listening to the radio and watching television that we were actually forcing the Press now to disclose their sources. What we said, and I have a personal interest in this matter because only last Friday there was a publication in a newspaper called the Citizen and they described a Member of Parliament as follows: "A very ...

30 Aug 2007 in National Assembly:
The amendment was simply that if you want to talk about Kajwang, just say it is Kajwang! Do not go around things and then say "name withheld". They said many other worse things. They said that, because my political fortunes are dwindling, I am now consulting witchdoctors!

That is a very serious allegation, but I do not want to go to court because I do not even know who

is. I might never even get my money. They may not even have any insurance. Assuming it was The Standard or Daily Nation, who published that story, and then I went to court and said: "I 3612 PARLIAMENTARY DEBATES August 30, 2007 have been defamed", they would say: "We never mentioned Kajwang'. They did the same to Kiunjuri. They described Kiunjuri without mentioning his name.

30 Aug 2007 in National Assembly:
Mr. Temporary Deputy Chairman, Sir, therefore, the amendment that was brought by our friend was very genuine. We are simply saying: The Press should not hurt us without taking responsibility. They should comment on matters of public interest, but comment truthfully, and nobody will bother them. However, if they publish scandalous things about you and then hide behind the fact that you are not named - even after describing you as to leave no doubt that it is you - thus denying us compensation, or even an apology, what are we supposed to do? This amendment is very genuine. The ...

30 Aug 2007 in National Assembly:
Mr. Temporary Deputy Chairman, Sir, I think we are in a big problem, because a Committee meets, calls relevant Ministers and makes a very comprehensive report, which the House usually agrees with because they take a lot of time to interrogate some of these things. When it comes, and it is laid before the House, we expect that the Clerk takes it up so that, by the time we deal with the amendments, at least, it is on the Order Paper. But in a situation in which it has not been included, then we have to deal with this matter ...

29 Aug 2007 in National Assembly:
Thank you, Mr. Temporary Deputy Speaker, Sir, for giving me the opportunity to contribute to this Motion. This is a Motion which should have come to this House 35 years ago. It has come to the House 35 years late. In 1972, before I even started reading economics, Kenya was already debating the idea of creating the capacity to produce power alcohol, which is alcohol that would be used to drive engines. It would be clean fuel which would not hurt our environment, but which would be cheap enough for our pockets. That would create jobs and empower our farmers. ...

29 Aug 2007 in National Assembly:
were a little more open to business than we are to our own citizens 40 years after Independence? Go to the place Mr. Omamba comes from, it is called Bogo. There is a falls there that is natural. It has been running for years. It was used to generate power to do mining when there was gold those days. It also produced enough power to pump water to supply that small town and the village around it. When they wanted to re-generate it so that it works again, they were told they must sell the power produced to the national ...

23 Aug 2007 in National Assembly:
Mr. Temporary Deputy Speaker, Sir, I want to confine myself to the provisions that seek to amend the Anti-Corruption and Economic Crimes Act. I will then say something about hate speech. May I start with the provision on Article 5 of the Anti-Corruption and Economic Crimes Act on page 1349 which says:- "An application for stay of proceedings in a prosecution involving corruption or an economic crime shall not be entertained at any time during the hearing of the case". Mr. Temporary Deputy Speaker, Sir, I know that the Director or Commission may feel 3460 PARLIAMENTARY DEBATES August 23, 2007 ...

23 Aug 2007 in National Assembly:
Mr. Temporary Deputy Speaker, Sir, to purport to make a law that would deprive a citizen of his or her rights to go to court and say that, "I feel that my fundamental human rights are about to or threatened with infringement", would be to take us to a communist State. We cannot just allow anything like this! In fact, Justice Ringera was my teacher. Of course, also the teacher for the Minister for Justice and Constitutional Affairs in the same class. He used to teach us evidence. Justice Ringera, then, used to teach us about human rights. When we ...
