For a long time, the Kenya Law Reform Commission was an institution that was basically without much results to show mainly because the country was not willing to adopt some reforms. Mr. Temporary Deputy Speaker, Sir, the process and standards of appointing officers to these commissions have been set by the law. The standards once set are really to be followed and at the end of the process, the public has a legitimate expectation; that even if the process does not possibly produce what the public expected, at least, there is substantial satisfaction by the public. There could be issues that may be dividing or raising controversy but, at least, the majority should be satisfied. In a process like this, it does not really matter who the individuals involved are. Mr. Deputy Speaker, Sir, I also stand to oppose the Bill. The rationale for this Bill quite clearly undermines the constitutional principles under which the public servants including the State officers are supposed to abide with. In the first place, in matters relating to remuneration and benefits, the Constitution clearly anticipates that the mandate for this is by the Salaries and Remuneration Commission which is the one to address matters of remuneration of public officers. On a point of order, Mr. Temporary Deputy Chairman, Sir. This Bill has been referred to the Departmental Committee on Justice and Legal Affairs and, once again, I want to indicate that it has not had time to look at this Bill. To us, it does really raise substantive issues that even relate to its constitutionality. Since, we have not had time to look at the Bill as a Committee, I wish that the Attorney-General could consider giving this Committee time to do so.
