Mr. Temporary Deputy Chairman, Sir, I oppose the amendment because if you delete the words âincompetence orâ, it means the clause would read the Secretary may be removed from office by the Commission in accordance with the terms and conditions of service for negligence of duty.

Mr. Temporary Deputy Chairman, Sir, ânegligence of dutyâ and âincompetenceâ are two different misdemeanors or misconduct. So, you cannot really say that incompetence is not a good reason to discipline somebody. I think both incompetence and negligence of duty should be there. So, I do not see the rational of the Vice-Chairman of the Committee---

Mr. Temporary Deputy Chairman, Sir, forgive me, but I would like to draw the attention of the Vice- Chairman of that Committee that this amendment may prove superfluous. This is because if you look at conflict of interest under paragraph 2, you will find that it deals with the issues being raised in that amendment unless of course I am having a different version of the Bill. What the hon. Member is trying to deal with is to lay rules of conflict of interest in the Second Schedule. I do not understand how that will make the situation any better.

Mr. Temporary Deputy Speaker, Sir, last week, Mr. Koech, demanded in this House that the Minister for Medical Services makes a Statement in the House with regard to the appointment of the Chief Executive Office of the Moi Teaching and Referral Hospital. Mr. Temporary Deputy Speaker, Sir, I have already discussed this matter with the Speaker and explained to him that my senior officials in the Ministry; that is the Permanent Secretary, the Director of Medical Services and the Chairman of the Board are all out of the country. Mr. Temporary Deputy Speaker, Sir, I said very clearly that my senior officials in the Ministry are not there. They are in a meeting in Geneva. The Chairman of the board is in the USA. Therefore, I cannot bring to this House an incompetent Statement. Therefore, I will wait until they are in the Ministry, so that we deliver to this House a competent Statement.
