  • 13 Aug 2014 in National Assembly: Hon. Chairlady, as you are aware Article 49(h) of the Constitution provides that every offence is bailable in law. What we have seen in the The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Hansard Editor. view
  • 13 Aug 2014 in National Assembly: recent past is that the courts cannot exercise any discretion at all; there is no latitude for the courts. Whenever an advocate applies for bail or bond for persons who have been charged with capital offences, particularly those who have committed murder and robbery with violence, the courts have granted bail because the Constitution provides that they must grant it. view

  • 13 Aug 2014 in National Assembly: I know that is the reason he is seeking clarification. view

We are just merely providing for discretion, but it is still subject to the Constitution; it will still be subject to Articles 24, and 49. Secondly, as hon. Ng’ongo may be aware, one of the laws that must be passed by the 27th of this month is the rights of persons detained in prison or who are in custody. That is going to be defined in that particular law. So, hon. Ng’ongo should hold his horses until we bring that particular law; he will find that ... view
