Hon. Temporary Deputy Chairlady, I propose that Clause 7 (2) be amended by deleting Sub-clause 2 of that particular clause as proposed by the Committee.

Hon. Temporary Deputy Chairlady, I wish to move an amendment by removing the words “in equal shares irrespective” in lines two and three and replace thereof with the words “according to”. Hon. Temporary Deputy Chairlady, this is so that if there is any property to be divided, then it must be in accordance with the share of each spouse’s contribution to the matrimonial property. This will ensure that no one person just sits and waits for the other person to acquire property and then claim half of it.

Hon. Temporary Deputy Chairlady, the new clause which is now Clause 7 and not Clause 7(1) will read as follows:- “Subject to Clause 6(3), ownership of matrimonial property vests in the spouses according to the contribution of either spouse towards it acquisition and shall be divided equally between the spouses if they divorce or their marriage is otherwise dissolved.” The reason we are proposing the deletion of Clause 7(2) is because it is inconsistent with the marriage itself.
