Mr. Deputy Speaker, Sir, there were about ten cases like the one of Benard which were filed. We have maintained the status quo up to now. Once we get this report, I promised the hon. Member that Mr. Makauâs case will also be taken into consideration. It was actually wrong for him to have been evicted. Once the report is out, which is by the end of June, we will call a leaderâs meeting to address the problem of Mr. Makau, so as for him to get his land back.

(b) Members of the Olenguruone Land Dispute Tribunal that are owed money in terms of sitting allowance are as follows:- Elly Langat â Kshs34,200; Susan Sitonik(deceased), Kshs31,800, Timothy Ngâeny, Kshs20,400, Richard Koros, Kshs9,600, Samuel Bett, Kshs38,400, Emily Simutei, Kshs43,800, Paul Kirui, Kshs22,000, Moses Mutai, Kshs62,400, Joshua Chepkwony, Kshs25,800, James Kosgei, Kshs60,000, Paul Kero, Kshs22,200. A sum of Kshs21,946,456 was factored in the Supplementary Budget Estimates to cater for arrears owed to members of land dispute tribunals ...

Mr. Speaker, Sir, once those monies are released by Treasury - because they have already been factored in the Supplementary Budget - I will do the needful.

Mr. Speaker, Sir, my primary duty is to factor in most of the monies owed to those members in the budget. But if I do not get what I have sought from Treasury, it will become a problem. But I believe that in the near future, this problem will be something of the past.

Mr. Speaker, Sir, the policy of the Government or of the Ministry is to actually ensure that those monies are released in good time. But because we do not get money on time--- Normally, we receive our budget with a deficit. Therefore, it becomes difficult to meet our demands.

Mr. Speaker, Sir, I beg to reply. (a) A district qualifies to have a land tribunal if the land adjudication process has been undertaken and beneficiaries interested registered or a settlement scheme is created and people interested registered. (b) Tana River District has a constituted Land Tribunal which was gazetted vide Gazette Notice No.10661 of 9th October, 2009. I wish to lay on the Table the Gazette Notice. (c) The tribunal already exists and, hence, there is no need of constituting and gazetting another one. Thank you.

Mr. Speaker, Sir, we normally gazette those names once we receive them from the District Commissioner. So, the hon. Member can just check with the District Commissioner. If the names are not the same, I am willing, even tomorrow, to have another list gazette. That is if that list is not accurate.

Mr. Speaker, Sir, that is a different question. In fact, about two weeks ago, I answered that particular Question. However, if need be, he could just ask another Question and I will actually go back to my office and give him the reasons why some of those members have not been paid.
