Where the office of any member becomes vacant, whether by death or Vacancy. otherwise, the Chief Justice may appoint another person to be a member of the Tribunal for the remainder of the term of the member whose vacancy cause the appointment.

Secretary of 24G. The Chief Justice shall appoint a Secretary and the Tribunal. such other staff of the Tribunal necessary for the proper functioning of the Tribunal. This provides for the appointment of the secretary to the tribunal, which is to be done by the Chief Justice. The funds for the management of this tribunal in Kenya under the new constitutional order is factored under the Judiciary funds. Therefore, the officer to administer the tribunal is appointed by the Chief Justice.
