  • 28 Apr 2015 in National Assembly: No! All these amendments are ours. We harmonised them together with the Committee. The Committee owns them but, in good faith, we are here to support and where it is not coming out clearly, we are here to clarify. view
  • 28 Apr 2015 in National Assembly: Hon. Temporary Deputy Chairman, the issue we are talking about could have actually been addressed if we had continued with the second part of my proposed amendment. We discussed this amendment for too long. What we are saying here is very unfair; it borders on a bit of illegality or unfairness for the four, five or ten of us to go ahead and open tenders, after which they are read out in public and I go home knowing that I lost or won the tender but later on, I am told that the tender of so-and-so was corrected and his ... view
  • 28 Apr 2015 in National Assembly: No! It was not harmonised by the Committee. The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Hansard Editor. view
  • 28 Apr 2015 in National Assembly: Okay. I am actually suggesting that I support this amendment the way it is but we could have made it better, just like they have said. Correction of rates is allowed because there is an error inside. You have to distribute the error within the rates inside for purposes of future variations. view
  • 19 Feb 2015 in National Assembly: Thank you, hon. Temporary Deputy Speaker. At long last, I am able to contribute to this Bill, which is very important. view
  • 19 Feb 2015 in National Assembly: Hon. Temporary Deputy Speaker, my voice is also low. I think I have to bend and get closer. It is true that I am a professional in this area. I am a Quantity surveyor of many years and prior to the emergence of the procurement profession; Quantity Survey has been and still is the professional in the major sector of procurement, especially in the infrastructure sector. Unfortunately, I am one of those who yesterday proposed about the 30 minutes and it has turned out to work against me and other hon. Members who are here. So, I will be very ... view
  • 19 Feb 2015 in National Assembly: Hon. Temporary Deputy Speaker, I think that is where we shall have to come in because we shall have to recognise the statutes that govern those regulated professional services and have them incorporated. That way, even if we have the procurement officers overseeing the work, the professionals have to do their work. That is because they have professional liability and they have to answer to their actions already in the statutes. It is something we shall have to look at and strike a compromise because I know in your profession and professions of many of us here, we cannot compete ... view
  • 19 Feb 2015 in National Assembly: comes to fees, there is this issue of under-cutting and the rest. It is not allowed and is against the existing laws. view
  • 19 Feb 2015 in National Assembly: We have discussed this matter and I have been in touch with quite a number of institutions, including the Institute of Quantity Surveyors of Kenya. I have talked to my colleagues who are lawyers as well as the architects and engineers. We are through with the Third Reading. Some hon. Members who are considering this might come up with amendments. We are not going to run away from procurement just like everybody else but, as professionals, we also need to respect the law that already governs our conduct with regard to procurement and our services. Hon. Temporary Deputy Speaker, I ... view
  • 19 Feb 2015 in National Assembly: He is my senior in the profession. I can listen to him any time. view
