Mr. Deputy Speaker, Sir, I do not have the answer yet. But I just want to report that we did get in touch with the Cabinet Secretary for Interior and Coordination of National Government. If you look at the Statement sought, the bigger component of it is about the boundaries and the Cabinet Secretary for Interior and Coordination of National Government did forward the same to the Independent Electoral and Boundaries Commission (IEBC). Mr. Deputy Speaker, Sir, when this matter came up last week, I pointed out to the Speaker that as a Committee, we realised that the Statement that was sought by Sen. Khaniri ought to have gone to the Committee on National Security and Foreign Relations but as a Committee, once an issue has been directed to our Committee, we did not have the liberty to change that. Mr. Speaker, Sir, I appreciate the frustrations that we go through when we ask for Statements. Sen. Khaniri is one of the Chairs of the various Committees. I have raised before that we do the best we can to seek these Statements from the various Ministries, in this case, the Attorney-General’s office. When the matter went to the Attorney-General’s office, he indicated that based on his assessment, the issue that was sought related more with the Ministry of Interior and Coordination of National Government and that he forwarded the matter to the Ministry. Thank you, Mr. Speaker, Sir. We, as a Committee, used Article 125 on several occasions. However, the predicament that we were in with regard to this Statement is that it was directed to our Committee, but if you look at its content, the only aspect that would relate to our Committee was on the boundary. However, every other aspect of the Statement relates to the Ministry of Interior and Coordination of National Government and the Standing Orders; the Attorney General forwarded the Statement to them. On a point of order, Mr. Deputy Speaker, Sir. Having benefited from the deep understanding of Kiswahili by Sen. Zani, in her contribution, she made references to a country and gave it the name “Amerikana .” I was wondering whether that is really the proper Kiswahili word for “America,” because we always talk of “Marekani.” Can she confirm that, that is the new word to referring to America?

Mr. Speaker, Sir, the Tobacco Control Regulations were gazetted on 5th December, 2014 under Legal Notice No.169 of 2014. The key purpose of the Regulations is to give effect to the Tobacco Control Act of 2007. The Regulations specifically address tobacco production, manufacture, sale, labelling, advertising, promotion, sponsorship and use of tobacco products, including exposure to tobacco smoke. The regulations were supposed to come into operation on 5th June, 2015.

The legal basis of the Tobacco Control Regulations, 2014, is premised on Section 53 of the Tobacco Control Act, No. 41 of 2007, which provides powers to the Cabinet Secretary to make regulations in the following terms:- The Cabinet Secretary may on recommendations of the Board, in this case the Tobacco Control Board, make regulations:- (a) For prescribing anything provided for or required by this Act to be prescribed.
