Mr. Temporary Deputy Speaker, Sir, your concern is also my concern, that the Police Commissioner, through the Director of Criminal Investigations, has not been complying and there are a number of files with directions to investigate. Under the previous Constitution, the Attorney-General could not enforce the directive, because the Criminal Investigation Department is answerable to the Police Commissioner and to the Minister in charge of internal security; the situation was not as at the time of Independence when the Directorate of Criminal Investigations was answerable to and was part of the State Law Office. Mr. Temporary Deputy Speaker, Sir, what we are now doing is that when we ask the Commissioner of Police to investigate a case, we give some indication of the time within which we expect a completed investigation file on our desk, or when we expect an interim report on the status of investigation and when the Commissioner of Police expects to complete the investigations. This is because time to investigate each case varies. Mr. Temporary Deputy Speaker, Sir, I cannot really table the names of those who conspired because the investigations can be prejudiced. What we are doing in many of these cases, where the police have had a long time to investigate and there has been no response, the Chief Public Prosecutor is giving the police 30 days to comply in accordance with the new Constitution.

Mr. Deputy Speaker, Sir, I beg to reply. (a) The land lease period remaining for foreign owned estates of Unilever Tea (K) Ltd, George Williamson (K) Ltd and James Finlays will expire in the year 2919 meaning there is a balance of 909 years. The said lease balance will be subjected to the provisions of Article 65 of the new Constitution whereby the allotees will surrender the 999 year lease in exchange of 99 years once the appropriate legal framework and mechanism is in place. Mr. Deputy Speaker, Sir, when we pass the national land policy. Our Ministry has embarked on preparing a Bill, so that the new lease of 99 years will be effective from the day we pass it in this House.

Mr. Deputy Speaker, Sir, it is common knowledge that if land was meant for the establishment of a school or hospital or stadium, and it was given to individuals, we will reverse its ownership.

Mr. Deputy Speaker, Sir, as I said, if it is something to do with leases of 999 years, we shall bring the Bill here so that once Parliament passes it, all the leases will be for 99 years. That is what was passed in the National Land Policy.

Mr. Deputy Speaker, the said land was leased out to those companies for a particular purpose. The companies have no right to sell the land. If there is something like that going on, anybody who is buying the land is simply being conned of his or her money. We shall not effect the transaction.

Mr. Deputy Speaker, Sir, I beg to reply. I am aware that the Social Hall in Watamu was allocated to an individual in 1999. However, according to the records available, the stadium is still intact. I have directed that a restriction be placed on the title deed pending revocation and repossession of the public land.

Mr. Deputy Speaker, Sir, we are aware of that and that is why we have referred this matter to the Kenya Anti-Corruption Commission (KACC) to assist us repossess this land like we have done in other areas. We will do that.
