Hon. Senators, on the request of the Senate Majority Leader via a letter referenced No.SEN/ML/2020/26/6 dated 26th June, 2020, and with the support of the requisite number of Senators, I appointed today, Tuesday, 30th June, 2020, as a day for a Special Sitting of the Senate vide Gazette Notice N0.4465 dated 26th June, 2020. In the Gazette Notice, I indicated that the business to be transacted at this Special Sitting shall be- (1) The National Drought Management Authority (Amendment) Bill (National Assembly Bills No.26 of 2019);

Hon. Senators, from the onset, I wish to draw you to Standing Order No.116 on Disorderly Conduct. It says- “(1) A Senator is disorderly if the Senator— (a) creates disorder; (b) knowingly raises a false point of order; (c) unnecessarily interrupts proceedings or consults in a disruptive manner; (d) fails to record abstention in a Division; (e) makes allegations without, in the Speaker’s opinion, adequate substantiation; or (f) commits any other breach of these Stranding Orders that in the opinion of the Speaker, constitutes disorderly conduct.” I appeal to you that we should not get to where I am forced to apply this Standing Order so that we are able to proceed in an orderly manner. Mr. Speaker, Sir, I understand why you have sought for voting by Roll Call. However, I would like to indulge you, because for those of us who are here, we have our cards and looking at the number of Divisions we have, especially in the Committee of the Whole, that the names of the Members who are on the other side be noted, so that they can vote by Roll Call or they can tick their votes, but for the convenience of the House, those who are here be able to vote electronically.

Mr. Speaker, Sir, the Secretariat should be a bit creative. Many at times, even when we vote electronically, there are some Members who do not have cards. In those instances, those Members without cards are called “assisted voters.”

Mr. Speaker, Sir, for purposes of convenience, I wish the Secretariat was listening, because they are the ones proposing, just like the situations - I am glad the Clerks at the table are listening - where some Members do not have cards, but the rest vote electronically, we can make the assumption that those Members on the other side do not have a card so that the ones in the Chamber vote as the “assisted voters.”

(Sen. (Prof.) Kamar): Hon. Senators, we are now moving on to the Consideration of the National Assembly Amendments to the County Early Childhood Education Bill (Senate Bills No. 26 of 2018). Hon. Senators, the first question is, that the National Assembly amendments to clauses 2, 8, 9, 15, 16, 20, 23, 24, 24, 25, 29, 30, 35 41, 43, 46, 47, 56, 63, 64, 66, 69, and the Second Schedule be approved. The Committee endorsed that. Hon. Senators, on the second question, that amendments to Clauses 27,28, 33, 36,37, 44 and 68 be approved. The Committee recommended a rejection. So, on question number one, the Committee accepted all the amendments except for the second set, where the Committee recommended ‘no.’ May I now put the first Question, which is that the National Assembly amendments to Clauses 2, 8, 9, 15, 16, 20, 23, 24, 25, 29, 30, 35, 41, 43, 46, 47, 56, 63, 64, 66, 69 and the Second Schedule be approved.

Order, hon. Senators! One of the businesses that I gazetted to transact today is the Third Basis for Revenue Allocation Among the County Governments. However, the Report in the form it is cannot be tabled in this House today. I am, therefore, directing that we have a Kamukunji on Monday, so that we are taken through the Report, to build consensus before it is tabled.
